University Impeachment Trial Opens in Neb.
Impeachment Trial Begins for University of Nebraska Regent Accused of Campaign Violations

LINCOLN, Neb. May 8, 2006 (AP)— Nebraska's governor took the witness stand before the state Supreme Court on Monday and talked about the importance of the oath of office as the impeachment trial of a University of Nebraska regent opened.

Regent David Hergert has acknowledged accepting an illegal campaign loan and failing to report a late contribution during his 2004 race for the board of regents. In a settlement last year with the state's campaign ethics agency, he agreed to pay $33,000 in fines.

The Legislature took it a step farther last month and impeached him. Hergert was immediately suspended from his post and it is now up to the Supreme court to decide whether to remove him from the board.

Hergert committed "a series of acts designed to cover up his manipulation of the election," the Legislature's lawyer, David Domina, said in opening statements before the justices Monday.

The Mitchell businessman has received nearly unprecedented attention for a regent, after he was fined for borrowing far more than is allowed by state law and for missing several deadlines that would've allowed his opponent, longtime regent Don Blank, to access tens of thousands of dollars in campaign finance "fair fight" funds.

Since then, the Legislature has passed a resolution asking him to resign or face possible impeachment proceedings.

Don't have the link but this is amazing, the lawyers statement. That's classic.

Lawyer outlines reasons for conviction of Hergert

An attorney for the Legislature made his case Monday for why University of Nebraska Regent David Hergert should be convicted for violating campaign finance laws.

“Democracy burns out, not brightly, if its elections are marred by fraud and corruption that rewards miscreants with incumbency,”

wrote attorney David Domina in a brief submitted to the Nebraska Supreme Court, which is to begin Hergert’s impeachment trial May 8.

Domina’s brief was in response to one filed earlier by Hergert’s lawyers asking the high court to dismiss the 10 articles of impeachment against him.
