Hastert says he'll work with Justice Dept.
WASHINGTON - House Speaker Dennis Hastert on Friday put Congress' constitutional tussle with Justice Department "behind us now" and said he's working with the Justice Department to set up guidelines for the FBI to review materials it seized from a lawmaker's office and any other searches of Congress' offices.

Hastert said he regrets that the FBI did not give congressional officials advance notice of their weekend search of the offices of Rep. William Jefferson (news, bio, voting record), or "figure out a way to do it consistently with the Constitution."

"But that is behind us now," Hastert said in USA Today. "I am confident that in the next 45 days, the lawyers will figure out how to do it right."

Hastert's move came after President Bush ordered that documents be sealed for 45 days, calling a time out in a fight between the legislative and executive branches over constitutional prerogatives.

2. Would this be the same Justice Department
that is NOT investigating him, and was going to sue ABC News for saying that it was?

More to the point, what is there to negotiate? The executive branch does not have the power to do what it did. Bush's action affects Dems and Repubs in Congress alike--unless, of course, Hastert has received some "assurances" from Bush that it will effect Democrats only. At any rate, reserving the right to raid Congresspeople's offices would certainly come in handy if a party in opposition to the legislative branch were to come into power...
