New London preparing for evictions in eminent domain dispute

NEW HAVEN, Conn. --City officials were preparing Monday to begin eviction proceedings
against residents who refuse to leave their coastal Connecticut homes, a move that
could signal the end is near in an eminent domain dispute that reached the U.S.
Supreme Court.

"I anticipate we are headed into the home stretch," New London Mayor Elizabeth Sabilia
said Monday morning, hours before the City Council was due to vote on whether to evict
the three families remaining in the Fort Trumbull neighborhood.

The small city has been trying for a decade to redevelop the once vibrant riverfront
neighborhood. Seven homeowners challenged the city's plans to seize the property and build
a hotel, convention center and upscale condominiums, saying eminent domain can't be used
to private development.

But a 5-4 Supreme Court ruling last year upheld the city's right to take the homes. Since then,
all but three people have settled with the city, taken money and left.

1. I hope that those who were forced to move...

...were properly compensated. These people need to be compensated for the value of their home
and for emotional damages.

I was in a jury pool for a local eminent domain case. The government took a man's house to build on the property. The man sued, because he said he wasn't compensated enough for the home, which had been in his family for three generations.

When asked about my opinion, I said that the government's actions were an abomination and that it had no right to take a person's property. I said that the action violated a citizen's basic Constitutional rights, and that anyone this happens to--should be compensated in spades.

Needless to say---I was not picked for the jury. The defense (the government) didn't really like my comments.

3. The real issue here is using eminent domain for private development.
It's one thing to take property for public works, yet another to invoke it for retail stores and the like which hold public benefit only as an afterthought (increasing tax revenue.)

I'd never be allowed on a jury for an eminent domain case once the court heard that my family home was razed for a new road. I have strong opinions on the subject.
