Judge dismisses most of phone-jamming suit

MANCHESTER, N.H. --A judge has dismissed most of a Democratic lawsuit against Republicans
stemming from the jamming of Democratic phone lines in the November 2002 elections,
a crime that led to criminal convictions against three former GOP officials.

State Democratic Chairwoman Kathy Sullivan said Thursday that a judge in Manchester
dismissed five of eight claims Democrats had made in the civil lawsuit. The ruling
was dated Tuesday.

Both parties called the decision a victory.

The dismissed counts alleged Republicans commited civil harassment and conspiracy,
including conspiring against Democrats' constitutional rights to vote and associate.
The remaining claims deal with interference with phone systems and seek compensation.

2. Notice the different emphasis in those two headlines....
AP tries to spin it as if the case were almost history. The Union Leader captures the essence of the Republican failure.

6. The NH Dems are fighting the RNC
Notice in the Union Leader article they quote local Democrats but the Republican quote comes from the Republican National Committee.

GOP attorneys could not be immediately reached, but Republican National Committee spokesman Aaron McLear said the court’s dismissal of the constitutional claim was a victory for his side.

and Dems also claiming a victory. It's more than possible that the lawsuit included a few tenuous claims as a buffer of sort.

9. This is the civil suit, remember.
The criminal cases have all been completed with guilty verdicts and jail time handed out.

Quite rightly!

I give the NH Democratic Party and Kathy Sullivan a lot of credit for not giving up on this!

GOP fails to squash phone-jam civil suit

Manchester – A judge today refused to end a civil lawsuit brought by the state Democratic Party against state and national Republicans.

Hillsborough County Superior Court Judge Phillip Mangones dismissed a constitutional claim by the Democrats that the GOP interfered with Granite Staters’ right to a free and fair election when Republican operatives jammed the telephone lines of Democratic and union get-out-the-vote phone banks on the morning of Election Day 2002.

But Mangones kept alive the Democratic claims that the Republicans “intentionally and repeatedly interfered with the use of their telephonesystems, rendering them essentially useless, apparently over a not-unsubstantial period of time.”

Paul Twomey, an attorney working with the Democrats, said the ruling was a victory for his side because the suit was kept alive. He said a goal of thesuit is to find out more about who may have been behind the phone-jam besides three operatives who have either pled guilty or been found guilty. The partywants to depose high-ranking Republicans, including former Republican National Committee Chairman Ed Gillespie.

11. Why don't these stories say why the judge dismissed certain counts?
The stories seem incomplete without that info.
