The Indiana Supreme Court unanimously rejected on Tuesday arguments that the law allowing the state to lease the Indiana Toll Road to private investors for 75 years is unconstitutional, clearing the way for the Daniels administration to move ahead with the $3.8 billion deal.
The justices also ruled that the case is a public lawsuit - upholding a ruling by a St. Joseph Superior Court judge that the challengers would have to post a $1.9 billion bond to continue to fight the case.
"It's over," plaintiff Steve Bonney, a West Lafayette farmer, said after the decision was released. "The high court's ruled and we pretty much have to accept that."
The justices, in upholding the lower court's ruling, said "no substantial issue is raised by the plaintiffs" that the law to lease the toll road is unconstitutional.
