Debate on Hill over power of the president

"What should Congress do if the president refuses to enforce a law - or some part of it he deems unconstitutional?

It's a question that has simmered in the GOP-controlled Congress over issues ranging from post-9/11 national security to the use of torture in the war on terror. "

8. You nailed it.
The President is sworn to protect and defend the Constitution. This President has done everything in his power to get around the Constitution.

"I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."

He's reneged on his solemn oath. Only the fact that Republicans are a bunch of toadies allows this nut to remain in office.

2. I think I missed something, here...
WHY is Rove assuming so much of the decision-making, speech making duties and providing 2006 candidate support as though he were president? He wasn't elected.

3. I really loathe this media game of playing dumb... what should they do?
Impeach. He has been caught breaking the law numerous times and trots out the lame excuse that he deems the law unconstitutional. He is not the effing judicial branch and cannot claim their powers, at least not yet.

???? shouldn't that read: "if he fails to follow and uphold the law and the constitution?"

'"For far too long, Congress has stood by and watched while President Bush has slowly expanded the unilateral powers of the presidency at the expense of the rest of the government and the people," said Senator Kennedy at Tuesday's hearing.'

If Congress doesn't develop a spine very fast and impeach him, he'll continue to steam roll our constitution all together. If that happens, they need to be thrown out of office right along with him.

7. I agree,
history shows that the bigger the car you let Dubya drive, the bigger the wreck at closing hour.

The biggest wreck will be the Scooter/Cheney pardon/martial law declaration, it could happen in Dec because things are gonna be pretty damn bleak as winter oil prices, the Republican massive election fraud, and the aftermath of this year's Katrina(s) become the second Bush** trifecta.

I fear that when the PNAC police state is declared, that is the last day of America as we know it.

9. I share your fears.
And if you look into the current list of who the members are of the Skull and Bones (not to mention the past list), you'll find some answers (including one surprising D.A.) as to why Rove was able to take a walk on the easy side in the CIA scandal - in my opinion. The Skull and Bones secret society, which puts its pledge above anything else, has members in very powerful places and well chosen roles. No coincidences as far as I'm concerned.

Speaking of history, junior and his advisor's are the most obsessed group of leaders regarding power, money and secrecy in our government. It has to change, we can't afford for it not to.

the AG and Justice Dept can challenge it. The courts are there to settle just those sorts of disagreements. Even if he has it stacked across the board to get his way, it is out in the public so we can all see for ourselves whether anyone is making any sense.

Edit to add: The fact that he keeps the signing agreements secret is more evidence that they really have no legs to stand on (just like going around the FISA court).

11. I worry then even if they don't have the power and the legs
to stand on, they'll still find a way to weasel and bully their opponents into not objecting them. Do you think that bush has even read the Constitution, as well as the Declaration of Independence, and has really thought about what they are and why they were created? I really don't think he has a clue...and I don't believe it suits him to know or care. I think it's an obstacle to his plans.

One thing that really scares me about the arguing going on back and forth over the issue of the wire-tapping for ex. at the highest levels, is that if bush and his advisors are able to circumvent the checks and balances that were put in place by our Constitution, he could create a pathway that whereas he can't be stopped. If they get away with doing whatever they wish in complete secrecy and no accountability in the name of "national defense", and he is successful in arguing that as the President, during emergency times (wars, etc) which can be indefinite, that he has, and must have, the last say on all things regardless what we think, the Congress or the courts, then we might as well tear up the Constitution and start over.
