Lawyers take step to clear Lay's record
Aug. 9, 2006

Attorneys for the late Ken Lay have taken their first step in an effort to wipe out his criminal record.

Samuel Buffone, a Washington, D.C., attorney who was expected to represent Lay in his appeals, filed a motion today asking District Court Judge Sim Lake to substitute Lay's estate for the late defendant so the lawyer can appear in court on Lay's behalf.

Buffone said in the motion that once the court recognizes him as the attorney for the estate, he will "move to vacate the convictions of Mr. Lay and dismiss the indictment."

The former Enron chairman was found guilty May 25 of all 10 charges he faced and was scheduled to be sentenced on Oct. 23. His co-defendant, ex-Enron CEO Jeff Skilling, was convicted of 19 of 28 counts against him and still is scheduled to be sentenced that day.

They can wipe all the records they want, it won't change the fact that Ken Lay died a crook and a liar.

5. I'm with you.
They're trying to clear Lay's record so that he can stop living like "some schnook" in the Witness Protection Program.

I have no evidence for this belief, beyond the fact that it's perfectly in keeping with what this most criminal Presidency in the history of our nation would do.

Now that I think of it, though, if Kenny Boy is alive he almost certainly isn't here in the United States, thanks to that terrible movie a few years back which suggested that if someone fakes his own death, then it's okay to kill him for real. That being the case, Kenny Boy probably couldn't work a register at a supermarket without worrying about a former employee breaking a bottle of wine over his head.

But most likely, he did himself in. He was worth more DEAD than he was alive. He really had very little to live for at this point.

This way, it saves a massive fine he now doesn't have to pay, and also completely wipes out his criminal record, and leaves a bit of doubt in the history books. Hopefully his evil will never be forgotten.

Assuming he's not alive somewhere right now, this so-called heart attack was probably self inflicted in some form, and I'm truly sorry he won't suffer for his deeds. Death is death, but it's not suffering. He and his family deserved that much.

7. Wow - that's quick! Many, many people who have been 'wrongly'
accused have waited DECADES for their name to be cleared (and STILL their families have no clearance)......how long has it it been since Mr. Lay has supposedly died???? 6 weeks or so???? :wtf: *sniff* *sniff* (and there is no evidence that he was "wrongly accused", in fact he was CONVICTED, AWAITING SENTENCING!!!! *sniff* *sniff* * does anyone smell something here*????)

9. I was never taught in "civics class" how to deal with such
chicanery (b/c "checks & balances" would take care of it all) ~ which obviously it isn't/can't (or there are no more 'checks & balances'. Are we left to "make it up as I (we) go along".....b/c this is B*llshit/unacceptable!

10. Its pretty much automatic
if someone dies before they get a chance to appeal the verdict, the conviction is overturned.
