Electronic voting firm drops legal case
Dec. 1, 2003 | SAN JOSE, Calif. (AP) -- In a major victory for free speech enthusiasts on the Internet, Diebold Inc. has agreed not to sue voting rights advocates who publish leaked documents about the alleged security breaches of electronic voting.

A Diebold spokesman promised in a conference call Monday with U.S. District Judge Jeremy Fogel and attorneys from the Electronic Frontier Foundation that it would not sue dozens of students, computer scientists and ISP operators who received cease-and-desist letters from August to October.

Bad day for Diebold- the EFF is going to seek damages and Attorney's fees.

Of course you have to ask yourself- what could the EFF have found out during the discovery process?

3. Maybe they dropped it because they had no case
Maybe they dropped it because it would expose their dirty little secrets in a court. Maybe they dropped it because they do not want to draw attention to the cause, just let it ride off into the sunset. I would be interested in knowing why they dropped it.

8. According to one of the EFF staff
who was at the arguments, Diebold's case just didn't have what it needed to win. She said NObody was on Diebold's side.

Also: coincidence or no, D Kucinich posted the link to the Diebold memos on his government website on a Thursday, and called for a Judiciary Committee meeting on it on a Monday, and it was that same Monday that Diebold said it was withdrawing its cease and desist letters.

I knew those cease and desist letters were worth less than a roll of toilet paper. Glad to see they didn't get away with their intimidation.

was a case completely without merit. diebold is looking more foolish by the day, yet they've done a great job of bribing/brainwashing a large number of election officials who now appear to work for them instead of the People.
