Federal panel quashes subpoena of DeLay and Barton

A three-judge federal panel on Monday rejected attempts to force House Majority Leader Tom DeLay and Rep. Joe Barton to testify in a lawsuit over Texas' new congressional districts.

The two Republicans had been issued subpoenas for deposition testimony, letters, e-mails and other materials in a lawsuit that seeks to block the new congressional maps.

The federal panel agreed with the lawmakers' attorney that only under exceptional circumstances, such as having unique information in a case, could they be subject to a subpoena.

Unless evidence is shown that DeLay and Barton might fall under that description, their testimony is not essential, the panel ruled. It did, however, leave open the possibility of reconsidering its decision during trial, which is set to begin on Dec. 11.

1. A-HEM!

The federal panel agreed with the lawmakers' attorney that only under exceptional circumstances, such as having unique information in a case, could they be subject to a subpoena.

DeLay had a huge hand being involved this, and so did Rep. Barton, and we're going to prove it, then spank the judge's asses for quashing it when it's WAY beyond reasonable doubt that DeLay and Barton did this.

4. Well, other than Delay telling Perry to GTF out of town
so he could use the governor's office in person to push the bill through, nah, he doesn't know anything special.

And Joe Barton, alleged Aggie, is obviously an AINO.

If this kinda shit gets common, gonna turn in my thumb!

5. I think this ruling may be well in line with precedent, though
I certainly don't know for sure. I think this comment is telling:

This may be simply how these things work. The judges may well yet allow the subpoena, but they want the trial to start first so they can get the information they need to make that determination.

Runaway democrats Garnet Coleman and Rick Noriega are attempting to mobilize all democrats in the city of Houston in support of their cowardly colleagues in the Texas Senate. The Harris County Democrat Party, along with the Houston Young Democrats, has organized a protest in front of my office in Stafford tomorrow from noon until 2pm.

I am calling on you today!

I am asking you to please come out to my district office at 10701 Corporate Dr. #118, Stafford,so that we may offer a counter-protest. I feel it is extremely important that the truth be told and that the media get both sides of the story.

Please help demonstrate to the entire State of Texas that we Texans do not run from a fight! It is vital that they realize that they were elected to represent the people in Austin not New Mexico or Oklahoma.

Together we can defeat those who try and flee from their constitutional duty.

This is about as much as he can do at this point (calling on us). He made a pseudo-vow a while back not to get directly involved in local affairs, and if he went on the attack (i.e. held a press conference) the democrats would run clips of him saying he wouldn't get involved in local affairs alongside clips of his press conference and try to embarass him.

I like how the democrats picked a weekday to protest - they know most Republicans have jobs and can't make it.

Oh I get it. It wasn't a vow it was a PSEUDO-vow. And emailing people in his district about a local issue saying "I am calling on you today! I am asking you to please come out to my district office at 10701 Corporate Dr. #118, Stafford,so that we may offer a counter-protest." is getting involved, but not DIRECTLY involved.

I can see how this sort of thing would be quite useful: "It wasn't sex ... it was oral sex ... I didn't directly participate in a sexual activity ... I just watched her perform a sexual act on me ... "

So Tom Delay is a sleeze bucket. Is that what you're telling me?
