SAN JOSE, Calif. — In a major victory for free speech enthusiasts on the Internet, Diebold Inc. has agreed not to sue voting rights advocates who publish leaked documents about the alleged security breaches of electronic voting.

2. It's significant for Democratic Underground.
Diebold has been sending cease and desist orders to many websites, including this one. We've spent quite a bit of money on our lawyer recently, trying to figure out what our rights and responsiblities are in this case.

At first we tried to find some sort of middle ground, and we were doing what we could to respect Diebold's claims. But Diebold continued to push the issue and made requests of us which we felt were a violation of our rights, and the rights of our members. In consultation with our ISP, we stopped responding to their cease-and-desist letters and stopped complying with their requests. (Thankfully, we have a very supportive ISP -- Diebold was picking on them, and they had absolutely no obligation to help us out.)

I talked to my lawyer about this yesterday. He says that this means our members can use DU to post links to the Diebold memos, without interference from Diebold.

In fact, if someone has a link to those memos, this would be a great place to post them.
