WASHINGTON (AP) -- In a concession to the Senate's new Democratic majority, four of President Bush's controversial appeals court appointees have asked to have their nominations withdrawn, Republican officials said Tuesday.

These officials said that William Haynes, William Myers and Terence Boyle had all decided to abandon their quest for confirmation. Another nominee, Mike Wallace, let it be known last month that he, too, had asked Bush to withdraw his nomination.

But this wasn't a concession. More likely it was fear of their nasty secrets being exposed during confirmation hearings.

they didn't want to have a real investigation into their sordid conservative pasts. With a rubber stamp Republican Congress in place they'd have taken the chance but with people that will REALLY examine the nuts and bolts of their careers......they want no part of it.

One of the biggest reasons getting 51 seats in the Senate was so good for this country. Shrub and his puppet string holders can't try to force any more of these nutjob morons through to Federal Justice Appointments.

Bush is going to have to cater towards more moderate judges if he wants to see any of his nominations make it to a floor vote. Leahy runs a tight ship and none of the 'Gang of 14' democrats (or Lieberman although he's pretty good at voting against activist judges) serve on Judiciary.

We may not like Lieberman (and I'm not asking anyone to like him) but for the sake of our judicial system, a system where judges get LIFETIME appointments, we need Lieberman to caucus with us

These officials said that William Haynes, William Myers and Terrence Boyle had all decided to abandon their quest for confirmation. Another nominee, Michael Wallace, let it be known last month that he, too, had asked Bush to withdraw his nomination.

Haynes is the Pentagon's top lawyer, and was an architect of the Bush's now-abandoned policy toward treatment of detainees in the war on terror. He had been tapped for the 4th U.S. Circuit Court of Appeals.

Boyle is a federal judge in North Carolina, and his appointment to the 4th Circuit provoked opposition from Democrats who cited his rulings in civil rights and disability cases, as well as his higher-than-average turnover rate by higher courts.

William G. Myers III, nominated to the 9th U.S. Circuit Court of Appeals, sparked opposition from environmentalist organizations and their allies among Senate Democrats.

Wallace's appointment to the 5th U.S. Circuit Court of Appeals drew opposition from Democrats, civil rights groups and the American Bar Association.

If we ever get past the current Constitutional crisis--does Congress really have any powers at all, or is it just a "quaint" institution, relic of days gone by, that provides a certain cosmetic gloss to the Bush Junta?--then we need to address the matter of this Junta's appointments to the courts. For instance, the Constitution does not specify the number of justices on the Supreme Court. Congress has the power to increase the number of justices, to balance the wingers that the Junta appointed. Congress could also appoint a Special Prosecutor, to dog their every hunting party, and look for ways to impeach them, or at least give them strong warning that they are being closely watched. Congress could also amend the Constitution to limit their terms, or make them electable. And a truly representative Congress might even venture into the matter of how the Dictator who appointed them got "reelected" in 2004 (--by his buds at Diebold and ES&S), and simply nullify all of his appointments.

Lots of creative ideas out here in the land of the brave, home of the free.
