Michael Moore Wins a New Court Round
http://sfgate.com/cgi-bin/article.cgi?f=/n/a/2007/02/20/entertainment/e170519S71.DTL&type=entertainment

Traverse City, Mich. (AP) -- Michael Moore won a round Tuesday in a court battle with the brother of Oklahoma City bombing conspirator Terry Nichols, but the plaintiff's lawyer said she is considering whether to take the case to the Supreme Court.

The 6th U.S. Circuit Court of Appeals in Ohio sided with a Michigan-based federal judge who in 2005 threw out James Nichols' suit accusing filmmaker Moore of libel and defamation in the Oscar-winning movie "Bowling for Columbine."

Nichols, a Michigan soybean farmer, contended that statements in the 2002 film could lead viewers to believe he was involved in the bombing. He also claimed the film invaded his privacy and inflicted emotional distress.

But a three-judge panel ruled unanimously that U.S. District Judge Paul D. Borman acted properly in rejecting the lawsuit. Borman found that Moore's statements about Nichols were "factual and substantially true."

2. Funny how people would get that impression
when all he did was cock a loaded gun and put it to his temple for kicks.

11. Shocking how anyone could misconstrue that for instability.
Especially during an interview.

5. Where's the money for the lawyer coming from
There has to be a lot of money put out there in legal fees, money for lawyers and all that jazz. Where's it coming from . The same place that all Paula Jones money came from when she sued President Clinton.

Those right wing nuts don't mind funding anything that will make a democrat look bad do they. It is a shame that we don't have an organization that goes after the republics for a change.

Ann Coulter would be a gold mine with all the trashy lies she spews about the dems.

6. I don't see this as a set back for the freeps at all
A harrasment suit isn't about winning. It' s about harrasing the other guy so much that he never wants to cross with you again.

Remember Oprah and the beef industry? I recall she won that as well. But she also doesnt' criticise the cattle industry anymore.

I have a sneaking suspicion that James Nichols has had some financial help paying for his lawyers.

7. Let me get this straight
Moore respectfully interviews the brother of a mass murderer, who then voluntarily shows himself to be mentally unstable.

And Moore is responsible how?

8. Meanwhile, Moore has had assets and time wasted
fighting this shit. The right doesn't intend to win any of this stuff, they're just trying to shut Moore down by wearing him down.

Are you paying attention John Kerry? Bill Clinton? Madeline Albright?

Sometimes winning isn't the point. Standing up to bullies is the point. It's not working for the right because the left has all the facts on its side.

It just might work for us. They do hate to lose money.

12. "Inflicted emotional distress"?
I think it was pretty clear from his own behavior in that film that he was quite emotionally distressed already.

Edited on Wed Feb-21-07 12:25 PM by underpants
they lived at your house while they planned this. They bought the bomb making material THROUGH YOU for crying out loud.

The fact that you aren't rotting in jail yourself is the only crime here.

14. Anyone remember when Jimmy went on Marcia Clark's
lie detector program on TV and he failed it on questions about OKC? He admitted on the program that he knows "things" that he couldn't "talk about".
