Attorney in Duke Lacrosse Case Dies

CHAPEL HILL, N.C. - Kirk Osborn, a lead defense attorney in the Duke lacrosse sexual assault case, died early Sunday, a fellow defense attorney in the case said.

Osborn had a massive heart attack on Friday and died shortly before 1 a.m. Sunday, attorney Joe Cheshire said.

Osborn represented Reade Seligmann, one of three Duke lacrosse players charged in the case stemming from a dancer's allegation she was sexually assaulted at a team party. The players were originally indicted on charges of rape, sexual offense and kidnapping, but Durham District Attorney Mike Nifong dropped the rape charges in December after the accuser changed a key detail in her story.

1. The Duke rape case
is falling apart, and should never have been brought. Nifong and the accuser are utter discredits to the human race. I sure wish he had been a Republican, but I guess it just goes to show that there are evil persons on both sides of the political divide. One side has more of them, though.

3. Have to wonder when the 88 are going to apologize or update their public position
The damage was not just to the 3 players or the just the Lacrosse team

9. They're not.
If they cared anything about right and wrong, they would never have done what they did to begin with. It was all politics to them. Expect an apology from Cheney and Rove first.

4. In Reade Seligmann's case, it is clearly an example of prosecutorial misconduct

and of a witness of questionable credibility. It was the Seligmann case that convinced me that at least one defendant was completely innocent and wrongfully prosecuted.

Actions by Osborn in the case included a motion with phone records and security camera images showing Seligmann would have been nearly a mile away from the Durham house at the time the woman said he was taking part in the attack.
