WASHINGTON - Karl Rove's lawyer on Friday dismissed the notion that President Bush's chief political adviser intentionally deleted his own e-mails from a Republican-sponsored server, saying Rove believed the communications were being preserved in accordance with the law.

The issue arose because the White House and Republican National Committee have said they may have lost e-mails from Rove and other administration officials. Democratically chaired congressional committees want those e-mails for their probe of the firings of eight federal prosecutors.

"His understanding starting very, very early in the administration was that those e-mails were being archived," Rove's attorney, Robert Luskin, said.

The prosecutor probing the Valerie Plame spy case saw and copied all of Rove's e-mails from his various accounts after searching Rove's laptop, his home computer, and the handheld computer devices he used for both the White House and Republican National Committee, Luskin said.

Luskin said Rove didn't know that deleting e-mails from his RNC inbox also deleted them from the RNC's server.


Up until this particular article, there has been no direct admission that Pigboy actually did the deed himself.

Fucking Congress and/or Fitz better goddamn do something about this lying traitorous sack of shit.

I am so disgusted with how slow this is all going as are a lot of us. Well, here's one....why can't we make a citizen's arrest of this guy (or whoever from the Bush admin) when they so much as cross the street wrong? Possession is 9/10th of the law (or used to be) and once we got 'em in the hoosegow, they stay....you know invoke the new gonzo laws of habeaus corpus et al that we have had to all live with.........I'd like nothing better than to corral Ms Pickles at the Mayflower using a duplicitious credit card to check in.

Unless the email admin is a republican or incredibly incompentent. Nightly backups are standards on nearly all corporate and gov email servers because there are times when it is highly important that people get back email they deleted.

in a normal environment w/ a default MTA config; but these are criminals we are talking about. it wouldn't be hard to configure a system that gives the user full control of client/server data.

“Karl has always understood that his R.N.C. e-mails were being archived,” the lawyer, Robert Luskin, said in an interview. “He has never asked or sought any kind of special treatment to permit him to delete anything.”

In addition to their government e-mail addresses, Mr. Rove and 21 other White House officials maintain e-mail accounts with the national committee that are supposed to be used for political business only.

Facing questions from Democrats and in the news media, the White House has said that some e-mail messages from the political accounts are missing and that it is working to recover them. The party committee, which until August 2004 automatically deleted e-mail from its server after 30 days, has said it has no e-mail records for Mr. Rove before 2005. But Rob Kelner, a lawyer for the R.N.C., said that work to recreate the lost records was under way on Friday and that some e-mail had already been retrieved.

On Friday, a watchdog group called on Patrick J. Fitzgerald, the special prosecutor, to reopen his investigation into whether Mr. Rove was involved in leaking the name of a C.I.A. agent. Mr. Rove had been cleared in the inquiry, but the group, Citizens for Responsibility and Ethics in Washington, said this week’s revelations about missing e-mail raised questions about whether he might have destroyed or hidden documents

IIRC, I read here earlier that Karl had access to the mail server and could/would delete them himself. The privilege was taken away from him in 2005? when the RNC found out that Fitz had ordered them all saved?

Rove in new controversy over e-mails

WASHINGTON (Reuters) - White House political adviser Karl Rove was embroiled in a new controversy over potentially missing e-mails on Friday, the latest twist in the firings of eight U.S. prosecutors last year.


The White House disclosed that the Republican National Committee in early 2006 took away Rove's ability to delete e-mails sent and received through a party e-mail account.

White House spokeswoman Dana Perino had no explanation for why the RNC, the governing arm of President George W. Bush's political party, would stop Rove from deleting e-mails.

Democrats looking into the Justice Department's firing of eight U.S. attorneys last year, which critics say appeared to be politically motivated, are seeking Rove's testimony and documentary evidence to determine whether he was involved.

The White House revealed this week Rove and 21 other White House officials have for years kept e-mail accounts through the RNC to conduct political business without violating the Hatch Act, which forbids government employees from using government property like handheld computer devices for partisan activities.

CREW WRITES PATRICK FITZGERALD ASKING TO RE-OPEN ROVE CASE IN LIGHT OF MISSING EMAILS

13 Apr 2007 // Washington, DC – Today, Citizens for Responsibility and Ethics in Washington (CREW) asked Special Counsel Patrick Fitzgerald to reopen his investigation of Karl Rove's role in disclosing Valerie Plame Wilson's status as a covert CIA operative in light of recent revelations about missing White House email.

Press reports indicate that Mr. Rove uses a Republican National Committee (RNC) email account for 95% of his communications. In addition, the RNC's counsel has admitted that all of Mr. Rove's emails prior to 2005 have been destroyed. Moreover, the White House has admitted that – as CREW reported yesterday – five million emails are missing from the White House servers. All of this raises serious questions about whether Mr. Rove knowingly destroyed evidence relevant to the Special Counsel's inquiry and whether Mr. Fitzgerald received all relevant documents.

Melanie Sloan, CREW's executive director, said today, "It looks like Karl Rove may well have destroyed evidence that implicated him in the White House's orchestrated efforts to leak Valerie Plame Wilson's covert identity to the press in retaliation against her husband, former Ambassador Joseph Wilson." Sloan continued, "Special Counsel Fitzgerald should immediately reopen his investigation into whether Rove took part in the leak as well as whether he obstructed justice in the ensuing leak investigation."

CREW serves as legal counsel to Joe and Valerie Wilson in their civil suit against Karl Rove, Vice President Dick Dick Cheney, I. Lewis “Scooter” Libby and Richard Armitage.

To me it looks like the system supposedly used to automatically archive all the e-mails. I searched for "enterprisevault" and got Symantec's site.

63. Remember Fitzgerald's letter to Waxman...
when he somewhat oddly threw in a suggestion that they peruse the Libby case records? During the lead up to the trial, he made this statement in response to a defense motioning claiming that he was withholding evidence from them. (Ah, the irony.)

"We are aware of no evidence pertinent to the charges against defendant Libby which has been destroyed," Fitzgerald wrote in a letter to the defense team.

But the prosecutor added: "In an abundance of caution, we advise you that we have learned that not all e-mail of the Office of Vice President and the Executive Office of the President for certain time periods in 2003 was preserved through the normal archiving process on the White House computer system." His letter was an exhibit attached to Libby's demand for more information from the prosecution." (January 23, 2006.)

a decent system would have incremental backups running daily and a full backup running weekly. There should be some tapes around somewhere that have those emails.
