Marine says found live children among Haditha dead

CAMP PENDLETON, Calif., May 8 (Reuters) - A U.S. Marine who walked through two houses in Haditha, Iraq minutes after other Marines killed occupants with grenades and guns found two wounded children pretending to be dead next to a deceased woman.

"I saw one breathe. That's how I knew," 1st Lt. William Kallop testified on Tuesday at a military tribunal at Camp Pendleton. "The little boy who breathed was about 6 or 7 and when I touched him, the little girl jumped up. She was about 11."

The two injured children were the only survivors of a Marine Corps assault on two Iraqi homes near the site of a bomb attack on a Marine convoy that left one Marine dead and two injured. Prosecutors contend that the surviving Marines swept through the town on a revenge spree, killing 24 civilians with grenades and guns.

Defense lawyers for the seven Marines charged in the Nov. 19, 2005, killings say the Marines were following procedure and orders.

Kallop, who led the first rescue team to come to the aid of the Marines struck by the bomb, testified he told Sgt. Frank Wuterich to clear two houses near the bomb site because the Marines suspected the bomb had been triggered from the houses and that insurgents were hiding within.

Because after all was said and done only one man was convicted and he only did 4½ months at a military prison at Fort Leavenworth.

More from the article. Haditha, Fallujah, places whose names haven't made it into the news, I am so sorry.

"I pointed to a group of buildings and said 'Flush them out, try to find the trigger man,'" Kallop testified, speaking in a matter-of-fact tone.Minutes later, after Wuterich's squad finished, Kallop walked through the two houses, where the majority of the 24 victims died, either from grenades or gunfire.

"I thought 'Hey, what the crap, why aren't there any bad guys, any insurgents here?'" Kallop said. "I thought that was within the rules of engagement because the squad leader was about to kick in a door and walk into a machine gun nest."

CAMP PENDLETON, Calif. - A Marine squad leader who led an attack that
killed 24 Iraqi civilians shot five men as they stood with their hands up
and told comrades to lie about it, a Marine sergeant testified Wednesday.

Sgt. Sanick P. Dela Cruz said that in the moments after a roadside bomb
hit a Humvee in his convoy Nov. 19, 2005, killing a comrade, he saw five
men standing by a white car with their hands interlocked behind their
heads. The squad leader, Staff Sgt. Frank Wuterich, then fired about
six to eight rounds at the men, Dela Cruz testified.

"They were just standing, looking around, had hands up," Dela Cruz said.
"Then I saw one of them drop in the middle. I didn't know what was going
on, sir. Looked to my left, saw Staff Sergeant Wuterich shooting."

Dela Cruz spoke at a preliminary hearing for Capt. Randy Stone, a Marine
lawyer from Dunkirk, Md. Stone is accused along with three officers of
dereliction of duty for failing to investigate the deaths.

Marine says urinated on dead Iraqi at Haditha

CAMP PENDLETON, California (Reuters) - Angered that a beloved member
of his squad had been killed in an explosion, a U.S. Marine urinated on
one of the 24 dead Iraqi civilians killed by his unit in Haditha, the Marine
testified on Wednesday.

Sgt. Sanick Dela Cruz, who has immunity from prosecution after murder
charges against him were dismissed, also said he watched his squad leader
shoot down five Iraqi civilians who were trying to surrender.

In dramatic testimony in a pretrial hearing for one of the seven Marines
charged in the November 2005 Haditha killings and alleged cover-up, Dela
Cruz described his bitterness after a roadside bomb ripped Lance Cpl.
Miguel Terrazas, known as T.J., into two bloody pieces.

"I know it was a bad thing what I've done, but I done it because I was
angry T.J. was dead and I pissed on one Iraqi's head," said an
unemotional Dela Cruz in a military courtroom in Camp Pendleton, north
of San Diego, California.

The NAZI executioners at Auschwitz were following proceedures and orders too.
The War Crimes tribunal at Nuremberg found that this is not a legitimate defense.
