Cunningham Transferred to San Diego Jail

SAN DIEGO (AP) -- Former U.S. Rep. Randy "Duke" Cunningham, who is serving more than eight years in prison for accepting bribes, has been transferred to a downtown jail, but his attorney and federal prosecutors won't say why.

Cunningham has been cooperating with federal prosecutors as they prepare for the September trial of Brent Wilkes, a defense contractor charged with bribing the congressman in exchange for contracts. Wilkes has pleaded not guilty to more than 30 counts of bribery, fraud, money laundering and conspiracy.

Cunningham, 66, is listed as an inmate at the Metropolitan Correctional Center across the street from the courthouse where he was sentenced in March 2006. He has been serving time at a medical facility in North Carolina and at a low-security work camp near Tucson, Ariz.

An attorney for Cunningham, K. Lee Blalack III, said he did not know how long the former lawmaker would remain in San Diego, declining to comment further. Prosecutors declined to comment on Cunningham's transfer, and an attorney for Wilkes did not immediately respond to a phone message.

He's earning his reduced sentence right now.

7. I'm not prescient, mind you ...
... just an observer of how these things have gone down in the recent past.

And Cunningham strikes me as the type of canary who wants to sing an entire opera, out of anger at being caged for doing what all the other dirty birds are doing (the ones who haven't been caught yet), and out of desire for things like pizza and scotch - treats that good canaries are promised for being good.

Although Lam has been removed- the case against Wilkes/Foggo and Wilkes/Michael is progressing. The US Atty who is now "acting" USA in San Diego - Karen Hewitt- seems not to be a political appointee AFAIK. And the same Prosecutors are working on the case. However, there seem to be a certain air of secrecy about certain aspects of the case that may or may not be justified.

The UT published the Feb 2007 interviews with Cunningham on Wed. Cunningham did a lot of co-operating in this interview although he may not have earlier. But the prosecution wanted the document kept secret. Today the paper revealed where the reporters got ahold of the documents.

Granger, the attorney for defendant Michael, attached a copy of the FBI interviews along with his recent court filing. And he sent a copy to the UT's lawyers as a "professional courtesy" since they sent him their brief. USA Forge complained because Granger had not blacked out "personal information" but the Judge "took no action on it."

I read the interviews and couldn't really find a reason that they would be sealed. There did not seem to be anything classified in them. And originally Forge had told the judge they would release them, but then changed his mind, citing that the information needed to remain sealed. Perhaps someone in Washington DC changed his mind for him. This, and an earlier "leak" that gave the defense a flimsy grounds for acquittal seem to make me suspicious that somebody is tampering with the case.

Kontogiannis' personal info is available from other sources- so I'm still wondering about why this was sealed in the first place.

Just look at the mansion and the yacht he used his position to get.

I'm guessing that a few months in that work camp have softened him up enough to name the big names.

jail ain't necessarily easier than the prison ... i think for the most part they might be worse. it may be for the prosecutors of the BW case comfort, and not cunningham's

22. I'm in San Diego right now and on the evening news they mentioned the Duke'ster was here and they
said it was so that he could be closer by in order to be interviewed by Attorney's in preparation for testimony etc. in the trials against Wilkes etc.

My guess too is that its for his own protection too...probably cut a deal too...that he could be closer to home while being safer.
