Democrats Dismayed by Mukasey’s Views on Executive Power

By CQ Staff Thu Oct 18, 3:41 PM ET

Attorney general nominee Michael Mukasey signaled Thursday he shares the administration’s expansive view of President Bush’s authority to withhold information from Congress, skirt federal statutes and authorize harsh interrogation techniques.

The retired federal judge’s statements, during the second day of his confirmation hearing before the Senate Judiciary Committee, put him at odds with the Democrats who will decide whether Mukasey succeeds Alberto R. Gonzales as the head of the Justice Department.

3. The Dems should make damn sure this man does not get the job.
But they're probably going to keep their powder dry for something more important. Just like they did with Roberts and Alito.

And the Iraq war funding.

And SCHIP.

And like they no doubt will by giving the telecommunications companies Carte Blanche to do whatever the hell they want to do since they have immunity.

Disgraceful. :(

6. Anyone who thinks the Commander in Chief is above the law
should never be confirmed as the chief advocate for a republic ruled by laws and not by men.

When the Dems confirm him they might as well recycle the Constitution as toilet paper.

7. But, but will Congress have the guts to refuse him the job of AG?
I have my doubts. Mukasey is very, very bad news.

I watched part of yesterday's hearing. He would give the most evasive answers to Dianne Feinstein and she would meekly say, "Thank you!"

8. I don't like it either, but I understand his legal philosophy
I think the prevailing standard is whether he has any principles at all - or is just another enabler in the white house.

14. Recommendation is
an understatement, Schumer was cheer leading his nomination vigorously! It seemed odd to me that a Democratic Senator would be so enthusiastic about a Bu$h nominee. Considering that Bu$h has demonstrated time and again that his choice would always be someone loyal to his twisted view of things, sort of his way of giving the Dem's the finger.

11. draw the line dems
There is simply no excuse for voting to confirm nominee for attorney general who believes that the President has the constitutional authority to do whatever he judges is necessary to protect the nation. I will not vote for any democrat who votes to confirm such a nominee. The commander in chief power is limited by human rights, constitutional rights, and by Congress's constitutional power to regulate and govern the armed forces. Are the dems going to confirm another attorney general who doesn't believe in the rule of law? If they do, they can go to hell. I don't want a king who is above the law. And anyone who thinks that for the sake of security, executive power should be unlimited--well, all I can say is that security is the highest value of the coward!

15. Credit where it's due - you are correct and put your views well here.
I like security too but, the doctrine that it trumps everything has the wee problem of being applied to a thousand cases where security is not truly at risk, but in its name, our liberties are turned to mud anyway.

12. WHY IS EVERYONE ON DU PRETENDING NOT TO KNOW WHO THIS IS!...
Michael Mukasey is a Bush bot who presided over the illegal Jose Padilla case and Larry Silverstein's knight in shining armor.

I am ashamed that no one will admit the truth that the guy who gave a kings ransom to an evil man like Larry Silverstein is about to become the #1 man in charge of Justice in Amerika.

Anyone man or woman enough to talk about this?

several posts days and weeks ago recommended calling D senatwhores to advise them to just vote no.

The cheerleading he received instead was dismaying.

and probably a lot worse than Gonzo.

The Nazis packed the judiciary in Germany who then gave them a green light for their genocide.

This is the same chapter in the NAZI playbook.

21. "Dismayed" - they'd probably confirm Gonzales if he were up again.
Edited on Fri Oct-19-07 05:53 AM by autorank
"Dis - fucking - mayed" - what nonsense. I wrote favorably about some of his decisions but also raised concerns about just this sort of thing. If this is his deal, then they should san NO.

On Edit: But they won't or 9 of them will say no and some asshole will go along with it, and there you have it.

Mukasey was very evasive in how he answered the questions, if he answered the question at all.
