Radio Host (Michael Savage) Sues Group That Quoted Him

SAN FRANCISCO (AP) - A conservative radio talk show host sued an Islamic civil rights group on Monday for copyright infringement over the organization's use of a portion of his show in which he called the Quran a "book of hate."
Michael Savage said the Washington, D.C.-based Council on American- Islamic Relations, or CAIR, violated his rights by wrongfully using a 4-minute segment of his Oct. 29 "The Savage Nation" show in a letter- writing campaign directed against talk radio advertisers. Audio from the show remained on CAIR's Web site Monday.

In the broadcast, Savage called the Muslim holy book "a throwback document" and a "book of hate."

"What kind of religion is this? What kind of world are you living in when you let them in here with that throwback document in their hand, which is a book of hate," Savage said during the portion of the broadcast highlighted by CAIR. "Don't tell me I need reeducation. They need deportation."

1. Gonna be tough to make that one stick
1) I don't think that phrase can be copyrighted

2) There is a fair use law that allows you to use portions of programming for political and/or educational purposes

3) CAIR is not trying to make a profit from it

on the plus side:

1) If weiner does sue...CAIR can probably turn around and sue him for filing a frivilous lawsuit and force the weiner man to pay for all their legal expenses

6. He's suing about a 4 minute portion, and that might...
be a violation of fair use.

It is a bullshit suit, and the judge will let us knowm, but 4 minutes seems a bit muich for fair use. That's a whole broadcast segment.

8. In my opinion, it does fall within "fair use." Since the purpose of copyright is to prevent
a third party from making monies off of another person's work (the first person) either has full control of the work or has waived it to a second party (publisher, network, etc.) in exchange for "consideration." I wonder if the plaintiff even holds the copyright of his broadcasts or if his network/agent/whatever it is that rabid weasels like him use to get on the air.

A short portion is fully acceptable for "review" purposes as is the full use to a limited audience for "educational" purposes provided that no one is charged to access such. That is to say, a professor can screen a copy of "Retour de Martin Guerre" to his French history class, but can't make the students pay extra beyond tuition to watch it.

Mr. "Batguano" or however he styles himself these days obviously can't read statute law and the interpretations on that horrendous Millenium Copyright Act, which is so convoluted that it takes interpretation committees and they still can't decide what it means.

Were Batguano/Savage to prevail, then higher education would be in a tailspin. Frankly, he will soon have librarians after him, which is a fate worser than death by Coulter.

We who practice the dark craft of librarianship can enlighten him as to what copyright is, why it exists and why he is an idiot in a few minutes and never even leave the reference desk.

9. either his lawyer is a dumbass OR he's looking to lighten weinersavage's pockets of some money
for himself. I cannot believe ANY knowledgeable lawyer would bring a suit against over a 4 minute clip. :eyes:

10. His lawyer will (probably) argue
that CAIR is using this to gain publicity for themselves (to raise money) and therefore CAIR would be making money off of A**hole's work. Not sure if it will stick (and it doesn't help that we're talking about a 4 minute segment rather than a sentence or two), but it will probably not be bounced quickly. As it is, both sides are getting free publicity of it. As long as the story stays in the news, both sides will let it drag on.

A CAIR spokeswoman, who said the audio was not a four-minute segment, but a series of clips separated by beeps, called the suit, filed in federal court in San Francisco, "bizarre, sloppy and baseless."

"We expect to prevail based on the facts, the law and the Constitution," Amina Rubin said.

Universal Orlando joins a growing list of advertisers that are yanking spots from syndicated Michael Savage's "Savage Nation" program over his recent attacks on Muslims. According to the The Hate Hurts America Community and Interfaith Coalition (HHA) advertisers that have already stopped airing include AT&T, AutoZone, Citrix, TrustedID, JCPenney, OfficeMax and Wal-Mart.

HHA, a group of religious and civic organizations seeking to challenge hate speech on talk radio, was formed as a result of Savage's attacks. Members of Hate Hurts America include public officials and civil rights advocates, as well as representatives of the Christian, Jewish, Muslim, Latino, and Asian communities.

Sigwart, who founded TBTM along with her husband Michael Stinson, aka "Symbolman," and Don Waller, aka "The American Stranger," points out that Savage has actually made it a point to threaten his critics with lawsuits and other harassment. On his radio show he called the defendants, GLAAD and other critics of his show "stinking rats" who "hide in sewers."

Savage said: "You live by handouts, all of you. You live off grants, all of you. You're a bunch of beggars... If you continue this, we're going to go after your funding sources. And we will do everything we can within the legal realm to cut off that funding. We are also going to go to the Justice Department under John Ashcroft."

The defendants say that the lawsuit doesn't make sense on a logical level for several reasons -- it names Sigwart individually, even though TBTM is a corporation and anything on the site is put there in the name of the corporation. The TBTM item in question is no longer on the site and was only there for a brief time to begin with.

"We took it off because we didn't think it was newsworthy anymore; Michael Savage is nothing to us," said Stinson.

Leavitt says that rather than defaming Savage, as he is accused of doing, he is merely quoting him. "He's the one that is defaming himself, and he's the one responsible for losing his own advertisers," he s
