Denver lawyer seeks to depose Cheney in assault case

Secret Service agents have given such varied accounts of what led to the 2006 arrest of a Denver man accused of assaulting Vice President Dick Cheney, the man’s attorney says there may be only one way to clear things up — depose the vice president.

David Lane, lawyer for Steven Howards, said he plans to file a motion in federal court in Washington, D.C., next week to question Cheney under oath. Attorneys for the vice president have refused repeated requests for a deposition, he said. “Given the wide differences of view, he is the only one with certain knowledge,” Lane said, according to a story in Friday’s New York Times.

According to a lawsuit Howards later filed in federal court, he was two to three feet away from Cheney when he addressed him. “I think your policies in Iraq are reprehensible,” he said. Howards told the Rocky that he may have lightly touched Cheney’s arm or shoulder, though the lawsuit makes no mention of any contact.

After the encounter, Howards continued walking down the street with his son. About 10 minutes later he was approached by Secret Service agents who accused him of assaulting Cheney. Howards denied the claims, but was taken to the Eagle County Jail, where he was held for about three hours and issued a summons for misdemeanor harassment.

Misdemeanor harassment? What the hell is that? Is that like if you tell an elected official you don't approve of something they did?

If that was a crime, that last telemarketer deserves the death penalty.

8. If he really did assault Cheney,
there's no way the SS would allow him ten minutes to walk away - he'd be in a sleeper hold on the ground in seconds. This reeks of bullshit on Cheney's part, long enough for him to stew again and again until he told one of his guards to 'go get that SOB' or something of the like.



How would you depose Cheney? His hand would make the Bible burst into flames during the swearing of the oath.

9. Well, the Supreme Court has already ruled, 9-0
When they allowed Paula Jones' bullshit case to proceed against President Bill Clinton, the Supreme Court ruled 9-0 that fighting the lawsuit wouldn't be much of an impositionon a sitting president. So taking just a deposition of Deadeye Dick can hardly be said to bring the entire U.S. government to a halt. No reason he shouldn't have to sit down and answer a few questions under oath.

DENVER (KWGN) — Local attorney David Lane, who's made his share of headlines with a number of high-profile First-Amendment cases, is taking on a new target: Vice President Dick Cheney.

Lane plans to file papers in federal court in Washington D.C. this week to question the Vice President under oath about an alleged assault that led to the arrest of a Golden man back in June 2006.

That was when Steve Howards was arrested by Secret Service agents just moments after walking up to Cheney on a sidewalk in Beaver Creek and voicing his opposition to the Bush administration's handling of the Iraq war.

"I said 'I think your policy in Iraq is disgusting' and I walked away," Howards said. "Ten minutes later, I was walking with my son and an agent comes up to me and arrests me for assaulting the Vice President."

"When it's gotten to a point when a person cannot walk up to an elected official and express their outrage, without fear of going to jail, it's a very sad time," Howards said. "And we thought this was an opportunity to bring that issue to the forefront."

David Lane, who represents Howards, has deposed several of the agents named in the lawsuit. Under oath in those depositions, the agents have provided differing accounts of the incident and have even accused one another of unethical and possibly even illegal conduct in the handling of Howards' arrest and then the recounting of it.
