Bush Finds Loophole and Appoints Pickering???
MSNBC just announced Bush found a loophole and appointed Pickering to a federal judgeship until 2005 bypassing Congress......that's all I have at the moment....anyone else see that?????

I suspect he interpreted (misstakenly) that his recent rise in poll numbers gave him some flexibility in using the recess appointment power.

I'm not in favor of it (I don't think it's constitutional), but I stayed silent while Clinton did it a few dozen times, so I can't yap.

Just make sure we run things come 2005 and vote him down. Until then, use him as a campaign issue (that would not exist if he just left him out).

WASHINGTON - President Bush installed Charles Pickering on a federal appeals court Friday, bypassing Democrats who had stalled his nomination for more than two years, sources said.

Bush appointed Pickering by a recess appointment which avoids the confirmation process. Such appointments are valid until the next Congress takes office, in this case in January 2005.

3. I heard it's called a "recess appointment" voted on again in 2005-
in the constitution ...congress will have to vote him down again next year.
