Former Obama opponent now suing to prove President-elect's citizenship

SACRAMENTO, Calif.- A former opponent of Barack Obama's has come back to haunt him over questions regarding Obama's citizenship.

According to a press release from the American Independent Party, former presidential candidate Alan Keyes and other members of the party have filed suit in California Superior Court in Sacramento to stop the state from giving its electoral votes to President-elect Barack Obama until documentary evidence is provided to prove Obama is indeed a natural born citizen of the United States.

Keyes also ran against Obama as a Republican for the U.S. Senate seat in Illinois in 2004. Obama won that election to serve his first and only term in the U.S. Senate.

The Obama campaign countered similar accusations early in 2008 by posting Obama's birth certificate online, and saying: "Barack Obama was born in the state of Hawaii in 1961, a native citizen of the United States of America."

along with Obama's. An uncensored version of Obama's birth certificate is on factcheck.org. McCain's is probably on the same site and if not has been posted on snopes I believe.

And if I'm not mistaken being born on U.S. government property such as a military base is legally the same as being born in one of the 50 states. So McCain was qualified to run.

The real point is that there are people that will cling to any baseless conspiracy because it reinforces their fantasy. Freepers have yet to provide a single piece of evidence proving that Obama was not a natural citizen. And Obama has provided a copy of his birth certificate along with its number.

And as with any conspiracy theorist, no amount of evidence will be enough. There will always be something "wrong" with evidence that debunks their belief.

I predict that these lawsuits will be laughed out of court and the rumor will live in the Alex Jones circles of the net.

The hospital at Coco Solo was built in 1941. McCain was born in a civilian hospital in Colon, Panama, which was also not in the Canal Zone.

I do some lurking over at Freeptardville, every time somebody there suggests that they give it up, and just look for conventional ways to block President Obama, they're shouted down with crap about the Constitution. It gives me hope, they should spend at least the next two years quite stymied by their inability to deal with reality.

If they get the message after the 2010 midterm elections, where we will gain a fillibuster-proof Senate even if the Yellow Dogs abandon us, they might pose a formidable challenge. Unless, of course, we can make sure they're saddled with Caribou Barbie!

Believe me, I haven't spent a lot of effort trying to get on top of this lunacy, but my vague recollection is that, under the law in effect at that time, he would not be a natural-born citizen if born in Kenya to an American-citizen mother, because his mother was under age 21 at the time. Or maybe it has to do with how long they lived in the U.S. after he was born.

Anyway, the point is that the only way he could qualify as President is through Hawaiian birth. That's the reason (according to Keyes and his supporters at FR) for this huge decades-long conspiracy by numerous individuals, newspapers, and government agencies.

And as for their stupid braying about "vault copies", I have gotten a number of birth certificates over the years and I have yet to get a photocopy of the actual certificate in several different states. What most states do is issue a document that contains the pertinent info only. And these documents are legal documents anywhere a birth certificate is needed. They are trying to argue that Hawaii would have issued a birth certificate for Obama saying he was born in Hawaii even though he was born in Kenya. How stupid is that. Vault copy indeed. No I would not take their word on any of this. They are likely misinterpreting the law - AGAIN.

I agree that your argument is anti-silliness. My title was prompted by a desire to give a quick indication of which argument I was disputing. Obviously, I disagree with Keyes, but I wanted to flag for readers that I was also disagreeing with one basis for disagreeing with Keyes.

because his mother was so young:

The following persons born abroad are U.S. citizens at birth:

A child born before November 14, 1986 to one U.S. citizen parent and one foreign national parent. Prior to the birth of the child, the citizen parent must have been physically present in the United States or its outlying possessions for a period or periods totaling not less than ten years, at least five of which were after attaining the age of fourteen

And since she was just 18 when Obama was born, she hadn't completed 5 years after attaining 14.

The suit is frivolous, though, because the State of Hawaii has already said he was born there; and someone even found the birth announcement in a Hawaiian paper. And why would Obama's mother have left where she was living (the wingnuts seems to think it was for Kenya, which was still a British colony then) to get what would no doubt have been worse hospital care, and less rights for the child?

Because Berg (and Keyes since a lot of his lawsuit is based on the Berg lawsuit), claim that Stanley Ann Dunham lost both her and Barack Obama's US citizenship when she married Lolo Soetoro and moved to Indonesia.

This claim is based on a VERY bad reading of the Nationality Act of 1940 and 1952 that only applies to marriages before 1922.

I was an attorney in VA for years and the trial courts there don't publish decisions so you won't find the actual order unless someone who received it, posted it. I've looked somewhat and can't find it. But, the synopsis is all over the Net and there was a case filed in VA so am sure this synopsis is accurate. Barclay Surrick of the US District Court for the Eastern District of Pennsylvania on Friday dismissed a lawsuit challenging the citizenship status and eligibility of Senator Barack Obama (D-IL) to become US president. The lawsuit , filed by Pennsylvania attorney Philip Berg, had alleged that Obama did not meet the constitutional requirement of being a "natural born" US citizen, arguing that Obama had lost his citizenship as a child when his mother married an Indonesian man, and had failed to reclaim it upon becoming an adult. Berg also alleged that there was insufficient evidence that Obama had been born in the US, and challenged the veracity of his Hawaiian birth certificate . Surrick dismissed the case, finding that Berg lacked standing to bring the suit because he did not face direct harm even if the allegations were true. Berg has said that he plans to appeal the suit's dismissal. AP has more.

A similar court challenge was previously made to the citizenship of Obama's presidential rival, Senator John McCain (R-AZ), arguing that McCain did not qualify as a "natural born" US citizen because he was born at Coco Solo Naval Air Station in the Panama Canal Zone, a military installation outside of US territory. US District Judge William Alsup dismissed that lawsuit in September for lack of standing.

It's like when I got sued in federal court years ago. I knew the entire case against me was total psychotic fabricated BS without a single shred of evidence, so I was never the least bit worried. It dragged on for years, but I never even hired an attorney or filed any documents. The case, involving 40 OTHER defendants, dissolved into nothing around me and just conveniently went away. My cost: $0. My effort: a single 5 page letter of response to the very sympathetic judge.

Keyes and his friends can rant and rave and use the legal system to harrass Obama all they want, but they don't have truth on their side, so this will always fail.

By the way, does anyone remember Tim Meadow's impressions of Keyes when he was on SNL. Fucking hilarious! I'll never forget the one after the 2000 election when he's parodying an Alan Keyes concession speech. It's starts of with this powerful looking shot of Meadows standing on platform while you hear wild cheers off camera. And then after he's done waving, Meadows quickly picks up a boom box with the crowd sounds coming out of it and switches it off. :rofl:

This bunch of fools, who have since run our country into the ground, began hounding Clinton before he took office, too. They never let up. It was amazing that he could get anything done. Isn't there some kind of law that would get rid of these harassing lawsuits? They'll continue to do it all through Obama's presidency, just as they did to Clinton. How can it be stopped?

By "This bunch of fools" I mean the right wingers. They proclaim to 'love our country' while they do everything in their power to restrict our democracy and interfere with the workings of the presidency.

They can go through all the pretrial work, go through depositions of hundreds of people who "know" President Obama was born in Kenya, spend many millions of dollars preparing their case.

President Obama will send one midlevel minion to LA with a copy of his birth certificate, which was issued in Hawaii because that's where Barack Hussein Obama II was born. He'll hand it to the judge as Defense Exhibit A. The trial will be over in two minutes. Dismissed with extreme prejudice and Keyes declared a Vexatious Litigant.

I figure anything that causes Repukes to waste megabucks is good.
