Judge allows Abu Ghraib detainees to sue Va contractor for torture, rejects immunity claim
Source: seattle times

ALEXANDRIA, Va. —

A federal judge has rejected a defense contractor's claims that it cannot be sued by torture victims at the Abu Ghraib prison in Iraq.

Arlington, Va.-based CACI had claimed it was immune from the lawsuit because it was only doing what the government required of it. The company also said the case implicates policy questions too sensitive for litigation.

But U.S. District Judge Gerald Bruce Lee rejected those arguments in a ruling made public Thursday and is allowing the lawsuit to go forward.

Four Abu Ghraib detainees — all of whom were later released without being charged — alleged torture and other crimes at the hands of CACI interrogators hired by the government.

8. If CACI doesn't like it, then THEY should sue the government and/or Rumsfeld too!
and the other members of the Bush cabal that "required" business of them this way...

Of course then hopefully we'll rip down this "State Secrets" privilege mess finally.

26. "Policy questions" instead of "national security concerns"?
Oh yeah; CACI can't hide behind national security without the aid of the executive branch.

Good luck with that.

"had claimed it was immune from the lawsuit because it was only doing what the government required of it."

Soo, the government required you to torture, let's see the memo on that please!

If this ever went to trial, it would be earth shattering for the Bush Regime.

12. You hit the nail on the head. If the government "required" this,
then were is the documentation stated this. It places the burden on them to prove their innocents. Will they fall on their sword to protect a two bit dictator or will they sing like a bird.

Dave grins from ear to ear.

13. I want to read that contract.
"So the party of the first part(US Government) requires as part of this contractual agreement, that the party of the second part(CACI) commit acts of torture in violation of international laws and agreements. For this the party of the second part will receive in payment an amount to be determined at a later date."

Or words to that effect.

29. Sorry CACI, the US government don't torture....
"........ claimed it was immune from the lawsuit because it was only doing what the government required of it."

Remember Bush said it, so it must be true. But, if you have have evidence to the contrary.

Then by all means submit it, and you and Bush can share a cell.

31. Spinning, spinning, spinning.
"Prominent Military Historians Assemble to Hear Dr. J.P. (Jack) London Speak About CACI's History and Our Good Name

CACI Chairman, Dr. J.P. (Jack) London, recently spoke to a distinguished audience of more than 40 senior military historians assembled at the Cosmos Club in Washington, DC. The renowned group of attendees included

* the Chief Historian of the U.S. Army Center of Military History
* the Director/Chief of Military of History of the U.S. Army Center of Military History
* the U.S. Navy’s Director of Naval History
* the Special Senior Historical Advisor to the Chief of Staff of the U.S. Army
* historians from the Office of the Chairman of the Joint Chiefs of Staff

In his remarks Dr. London emphasized the importance of integrity and always "doing the right thing" at CACI. This was presented in the context of setting the historical record straight about CACI and its work in Iraq, using as a powerful reference point his book Our Good Name.

Dr. London recalled the events of the Abu Ghraib crisis in 2004 and described how it led to the idea of writing the book. He outlined the detailed approach to writing a book that he felt needed to be a faithful and "factual narrative of our ordeal." Dr. London explained how during the crisis CACI and its work in Iraq were often inaccurately portrayed in the media. There were also many egregious and baseless allegations about the company, despite its efforts to set the record straight. The approach included using official records, sworn testimony and other credible sources to tell CACI's story. It also meant extensive fact checking, footnoting, indexing and other practices often used by historians.

With Our Good Name Dr. London said that CACI's side of the story could be heard in its entirety while adhering to the "integrity of the historical record." And he reminded the audience that all royalties are donated to disabled veterans' charities for those who have proudly served our nation. "

33. maybe some money will change hands
and these victims of CACI torture will get compensation, but until I see jail time for the CEO and higher-ups, it won't be enough to simply hit them in the pocketbook. They have to face the most severe forms of punishment, which is to say, many years of jail time under rather austere conditions. That will send a message that these contractors for our bloated military industrial complex no longer get a free get-out-of-jail card from the government, when something wents out of control, the higher-ups have to face the music, not finding a few patsies for the fall guys.
