Coleman Asks Minnesota Court for New Chance to Overtake Franken

Coleman, Franken Case Argued at Minnesota’s Top Court (Update1)

June 1 (Bloomberg) -- Republican Norm Coleman asked the Minnesota Supreme Court for another chance to overtake Democrat Al Franken in the seven-month legal fight for a seat in the U.S. Senate.

Coleman’s lawyer urged the justices to throw out a lower court ruling that declared Franken the winner of the Nov. 4 election, and to require the counting of hundreds of absentee ballots that were ruled invalid. Coleman lawyer Joseph Friedberg argued that absentee ballots in different parts of the state were treated differently.

“We have significant disenfranchisement,” Friedberg told the court during arguments today in St. Paul. “Depending on where you sleep, that depends on whether your vote gets counted.”

Franken’s lawyer, Marc Elias, said the only issue is how many ballots were properly cast for each candidate. “The question answers itself,” he said. “Al Franken received more lawfully cast ballots on Election Day than did Senator Coleman.” Franken is asking the justices to order him certified the winner.

4. .This is not a Presidential election. SCOTUS cannot decide this. It must be decided by the Senate.
Article I, Section 5. Each House shall be the judge of the elections, returns and qualifications of its own members, and a majority of each shall constitute a quorum to do business; but a smaller number may adjourn from day to day, and may be authorized to compel the attendance of absent members, in such manner, and under such penalties as each House may provide.

So Bush V. Gore is irrelevant to this case.

That the Senate could do what it wanted to do, regardless of the findings of these proceedings in this court.

8. The only thing I can see SCOTUS doing in this case is establishing a bright line.
They could hear the case just long enough to determine that all State appeals have been exhausted. That SCOTUS has no authority to hear the case beyond determining that all state appeals have been exhausted. This race and case must now be determined by the Senate. If they even do that. But that's about the only thing they can do. Affirm the Senates right to determine the winner.

So we should have their asses plastered across the evening news everytime they show it. The vote on deciding the election should be the first order of business on Monday morning. Then we can keep their asses on the front page all week.

36. You do know this currently has nothing to do with the SCOTUS?
The case is currently in front of the Minnesota Supreme Court. The SCOTUS is not involved (yet). I don't doubt that Norm will try to take it to the SCOTUS when he gets slapped down by the SCOM.

I don't think that Pawlenty will have the cojones to hold up the election certificate once the Minnesota Court tells Norm to act like a grown-up, but you never know.

9. Didn't Bush v Gore hold votes at what was counted?
Why would Coleman argue that the votes as counted should remain. Although, there was a clock to run out in the presidential election, which the five Republican appointed members of SCOTUS did run out, giving from 10PM to midnight to count six million votes -- an impossibility. Here there is no clock running out. Franken wins with the current vote.

So, further, the statewide recount is already done, and Franken won that.

So, I'm gathering that all Coleman could have is a bunch of faulty ballots questionably cast and invalidated all for good reasons that even Coleman's camp agreed were faulty from the start.

And we still wait for this. I call foul play.

He knows he lost. It's the Right's efforts here, not Coleman's. They'll prop up Norm's invalid argument as looooooooooooooooooooooooong as they can. It's another trick of their's to inhibit the work of the Dems (as called out by the majority of voters last year). Again, the party of the minority is calling the shots! What an incredible, indefensible, infantile irony.

it's going back to the Minnesota Supreme Court today whether to uphold the lower court ruling that declared Franken the winner. Watch this one folks. Recent polls show that Minnesotans want this to end saying Coleman should concede. 2/3 believe Franken is the winner. Justice Dietzen is himself a two-time Norm Coleman donor! But hasn't recused himself.

I have confidence that it's going to happen. And when it does, watch the GOP scream in mortal agony.

Although I don't equate the two men at all, imagine our feeling if Glenn Beck were elected to the Senate, providing a clear majority, sort of.
