Charges against Cyril H. Wecht to be dismissed

U.S. Attorney Mary Beth Buchanan this morning filed a motion to dismiss all of the charges against former Allegheny County Coroner Dr. Cyril H. Wecht.

In a news conference, the prosecutor said that a ruling by U.S. District Judge Sean J. McLaughlin last month suppressing crucial evidence in the case severely hampered any chance her office would have to move forward.

Though the charges filed against Dr. Wecht more than three years ago have been dismissed, Ms. Buchanan said she still believes that a crime was committed.

"However, in our society everyone is innocent until proven guilty," she said. "As we stand here today, he's still innocent.

Can someone tell me why Bush U.S. attorneys are still working and haven't been asked by the Obama administration to tender their resignations? I heard Thom Hartmann ask same question regarding this the other day in relation to Siegelman prosecution.

Some Bushies decided not to tender resignations to Obama. That is irrelevant. Political appointees can be fired, without triggering due process protections, to which only civil service employees are entitled. Two hings, however, affect the way things have always worked:

One, as Marcia Godling testified before Congress, she illegally screened civil service employees for political affiliation and other beliefs.

Two, just before Bushco left office, they converted some political positions into civil service positions, making some of their appointees much harder to fire.
