Minn. court orders Coleman to pay $95,000 to Franken
Source: Mpls Star Tribune

Republican Norm Coleman owes Democrat Al Franken $94,783 stemming from his Minnesota Senate election lawsuit, with the amount subject to interest.

A Ramsey County court administrator officially entered the judgment on Wednesday. It's a holdover from the two-month trial that ended with Franken up by 312 votes.

In the US, we do not have a "loser pays" system. In the course of litigation, when someone does something particularly boneheaded, a court can award fees, but only for the part thereof deemed to be boneheaded.

And, no, it is not "boneheaded" merely to be on the losing side of the overall case.

95. If Franken's legal fees are around $3MM (A feasible number), then
Coleman is only being asked to pay about 3% of that number. I would say that a good deal more than 3% of his case has been severely boneheaded!

This is about court costs, not legal fees. I erroneously referred to fees above. The article is clear that this relates to costs, not fees. Fees are only awarded in very unusual circumstances.

This is becoming outrageous. If I were Minnesota voter, I would be so mad. They are not being represented in the same manner as the other states. It is obviously a fault in their voting laws that if I were a citizen of that state I would be insisting be changed, prior to the next election.

37. We do have a good electoral system here. It just got stressed to the limit this time.
We are looking at our processes. I know there is some talk of having early voting instead of reliance on absentee voting (which is the cause of all the hoopla right now.) We'll figure it out.

some are losing patience, but we tend to believe there is a process, we will be done soon. Now if Coleman appeals to the US Supreme Court, I think outrage will service. We Minnesota voters have been patient with our Minnesota process, but taking it out of Minnesota is not our way.

Franken's campaign raised funds to cover the costs of a legal recount based on Minnesota state law. Coleman's people have run an obstructionist and obvious stall to the seating of a US senator by way of out of state political interests waged in a frivolous manner.

Perhaps it is that spirit that the judge decided against Coleman for costs. Or maybe this is a hint to Coleman.

I have not seen the decision but that's how you get fees. The case brought against you was so
unsupported and poorly presented that it shouldn't have been brought in the first place. This
is very significant and a victory for Al Franken.
