Democrats ask court to block NY Senate coup

ALBANY, N.Y. (AP) -- The New York Senate's Democratic conference says it's headed to court to try to block the coalition that claims it took the majority power of the chamber Monday in a parliamentary power grab.

Democratic spokesman Austin Shafran says the conference will seek a court order to block the coalition of Republicans and two dissident Democrats from opening the Senate session Thursday.

1. Its become a circus.
This shouldn't be decided by fiat. Let them use the coup as an issue to dominate in the next election.

So it was not a valid or legal.

3. The Democrats tried to adjourn...but didn't have the votes.
They then continued to pretend that they had adjourned.
Adjournment needs a majority approval. That obviously didn't happen.

when they come back, it's just going to happen again anyways, isn't this delaying the inevitable?

It is what it is, two corrupt Dems went to the highest bidder. There is sometimes a price for doing the right thing and in this case, it is that we have to wait a little longer til these two yahoos are in jail and/or out of office and can be replaced with two at least slightly less corrupt folks to put in there and regain the majority.

What court would rule on this? Are the Dems going to not open another session until, well when exactly because they know the moment they do this will happen again and will be valid and legal, however despicable?

... the Dems still have a majority, do they not? If two Dems refuse to conduct business with their declared party, fine, but this does not make Repugs the majority in the state senate. When the turncoats actually buck up enough courage to change parties, then they can be recalled or something...

Or is all that too reasonable and logical for politics?

12. Doesn't go by parties, unfortunately
Seems the NYS Senate rules demand a majority "conference" not majority party to control the body. Rules were probably created before parties became a major force.

Of course since we elect state Senators under the assumption that the majority party will control the Senate, it is a clear betrayal for renegade Dem Senators to form a "conference" with all the Republican Senators.

6. From what I heard
the court allowed the Repub's to go into session. But, of course no Dems showed up so they got nothing done. I even heard scumbag conspirator #1 Hiram walked out because there were no Dems. What an Asshole.

I've ever heard of to become law. Espada is using bringing it to the floor as bait for Dem participation in the session tomorrow.

It also reported that the legitimacy of the new coalition conference would be put before a judge tomorrow morning, before the time the coalition planned on having their arguments ready, so, depending on the actions of the judge, the session might never take place.

Curiouser and curiouser.
