Kent County Commissioner Dean Agee loses concealed weapon permit
by Jim Harger | The Grand Rapids Press
Friday August 07, 2009, 11:20 AM

GRAND RAPIDS -- Kent County Commissioner Dean Agee lost his right to carry a concealed weapon Thursday.

The Kent County Gun Board suspended his concealed weapon permit pending the outcome of a misdemeanor weapons charge against Agee in Osceola County.

Agee, R-Grand Rapids Township, was charged with careless discharge of a firearm after a July 18 incident on property he owns near Evart, 80 miles north of Grand Rapids.

Agee and a friend, Plainfield Township veterinarian Richard Rinzler, were charged after stray bullets from Rinzler's 50-caliber machine gun traveled 2 miles and struck a trailer and pickup parked at a dulcimer music festival.

I'm sure that Agee qualifies for some sort of Dick Cheney award.

5. Also, completely illegal in the State of Michigan.
Like Washington State, NFA weapons are not legal for private citizens to possess.

Either this guy is completely fucked and going to jail with a felony, or he had a .50 caliber rifle, not a machine gun.

In any case, he's a dipshit, for either not using a backstop, or using an insufficient backstop. For rifles that powerful, if the round skips off a rock or hard surface, it can go miles. All the more likely if it was milsurp steel core rounds.

FIREARMS:

MICHIGAN PENAL CODE:

Possession and transfer of a machine gun

A person in Michigan may only possess a machine gun if it was lawfully possessed before May 19, 1986, and is properly registered under federal law. A person in Michigan may only transfer possession of a machine gun if authorized to do so by the federal Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives.

17. Doh
"Of greatest relevance to your question is the exception stated in subsection 3(c) above. Michigan law, therefore, prohibits the possession of a machine gun by a person unless that person has been "licensed" by the United States Government to manufacture, sell, or possess the weapon."

Penal code I looked at earlier didn't have that. My mistake. Guess Michigan has weaker gun laws than Washington State. :D

I won't use "morans." That's their mistake, so there's no need for me to perpetuate it.

18. They should take all firearms away from him.
If he is stupid enough to shoot a firearm without having a backstop, bullet trap, earth mound or some other type of impediment to having a high-powered rifle round leave his property, he has shown that he doesn't posess the intelligence or foresight to properly handle a deadly weapon in a safe manner.

Luck is the only thing keeping him from a charge of manslaughter.

21. .50 caliber rifles aren't quiet.
If they fired more than one shot, the people downrange heard it, I'm sure.

22. There are not many 50 caliber weapons around.
It would be a fairly straightforward process to see who owns one nearby, and do a forensics match of bullet to barrel.

You can extrapolate backwards from the target the trajectory of a fired round, based on ballistics.

I'm fairly certain police asked around the locality for witnesses, to see who was shooting nearby that day.

A 50 caliber round makes a noise you can hear miles away, I'm sure someone pointed them in the right direction.

Lots of ways.

23. Thanks - I was wondering how they found him, too.
I have a cabin in the mts in a development that doesn't allow discharge of firearms. But occasionally you hear them. Now I know it's not impossible to figure out who is doing it, I may be able to take some action. I've heard bullets whizz through the trees near me when I'm outside.

25. Not fun. I've had to hit the deck more than once as shot and shell flew overhead.
Inform the local law enforcement each time it happens, file a report, get it on record, even if they seem indifferent to it.

People need to be made responsible for their actions, especially when firearms are involved.

I own and use firearms, and people like that piss me off to no end. They make the rest of us look like slobs.

31. Agree with you I am a Range Safety Officer at a local shooting Club
Hunting, shooting and collecting are noble pursuits. Some idiots like this need to be called out.

I also wonder in the story, if this guy didn't have a Barrett or some other clone. You know press accuracy.

A fully automatic M-2, Ma Deuce .50 is really really expensive like $15,000 expensive.

32. I need to ask you a question, then, since you would most likely see
far more of this than the limited time I get to spend on the range.

The worst shooters I ever see in person, and the people most likely to handle a firearm in an unsafe manner, are almost always LEO.

I had to leave the indoor pistol range once because the one of the local police ossifers kept shooting the ceiling halfway downrange, and kept scaring the crap out of me.

My buddy was going to try to help him, (he's an instructor, used to shoot for the ONG at the Camp Perry Nationals) but he was having none of it.

God only knows how he ever qualified.

Not the only time something like that happened, either.

33. I can't generalize on this question.
Around here, most of these types, have their own range.

I will agree with one thing though. I do however, see carelessness on the part of individuals who should know better.

Familiarity sometimes breeds contempt for safety.

24. If the sheriff's dept approved his backstop..
.. then he should raise a stink at them, too.

"Before the weapon was fired, Agee said he invited sheriff's deputies to review the shooting area to assure it would be safe."

(Doesn't say if the sheriff's dept actually came out, though.)

Seems pretty stupid that one would try to be responsible about shooting, then let something like this happen.

But after a few beers...

Edited on Fri Aug-07-09 06:26 PM by X_Digger
.. fairly close to each other in where they landed, I'd have to think it blew through the backstop. Could be a crazy coincidence though.

eta: http://www.mlive.com/news/grand-rapids/index.ssf/2009/07/sheriff_defends_deputies_respo.html

"Police said two rounds from the assault weapon went through the roof of an occupied trailer at the music festival, shattering a window on the way out, and a truck."

"Agee invited police to review the shooting area before his event. Authorities -- although they had no regulatory ability -- inspected the site and believed it posed no threat of harm, Crawford said."

http://www.cadillacnews.com/articles/2009/07/24/archive/1018846.txt
"Nearly 50 people fired the weapon and not one of them was Mr. Agee," Elmore said.

Looks like it was an NFA registered machinegun-

"An inquiry about the weapon’s demonstration also will be undertaken by the Bureau of Alcohol, Tobacco, Firearms and Explosives - the federal department which issues federal firearms’ licenses required to sell the machine gun fired at the demonstration, according to Donald Dawkins, Public Information Officer with the ATF in Detroit.

"We didn’t immediately receive information, but we are going to look into it," Dawkins said.

Dawkins said the ATF has received several civilian complaints and soon will look into the incident further.

"It’s a process to go through," he explained. "But certainly, with substantial violations, we can revoke the license."
