Judge questions Orly Taitz claims to have Obama birth certificate...

The fun never stops....

During a hearing in U.S. District Court Monday, an attorney for an Army officer fighting deployment to Iraq questioned Barack Obama’s legal right to serve as president, asserting he was born in Kenya, not Hawaii.

Judge Clay Land, inquisitive throughout the 90-minute hearing, said he will issue a decision on Capt. Connie Rhodes’ request for a temporary restraining order by noon Wednesday.

Rhodes was represented by Orly Taitz, a California lawyer and a national figure in the “birther” movement that claims Obama does not meet the qualifications to be president.

In her final argument, Taitz asked Land why she had to prove a “Kenyan birth certificate” she submitted as evidence was authentic, yet her opponents didn’t have to prove Obama had an authentic United States birth certificate.

She has previously served at Fort Gordon near Augusta, Fort Rucker in south Alabama and Fort Riley in Kansas.

She is currently at Fort Benning, awaiting deployment in the next week. She arrived here over the weekend.

Under questioning from Land, Rhodes said she had not declined any other orders since Obama became president.

“If Sen. McCain would have won, would you be objecting to deployment to Iraq?” the judge asked. Rhodes said no.

Land then asked the question another way: If President George W. Bush still was the commander in chief, would she be fighting the deployment?

“No, sir,” Rhodes answered.

It might have been better had Judge Land asked "If Condoleeza Rice was President right now, would you object to deployment to Iraq?"

I've just seen too many unbelievable things of late. It wouldn't surprise me a bit.
I thought after Obama/Biden won, it would be the start of restoring/regaining our country, but it doesn't look like it's even close anymore. It's like they cut the straps on all the freeper's and GOPers straightjackets.

33. Even if the judge issues a temporary stay this won't be over......
A temporary stay would simply suggest that the judge felt the arguments and facts were sufficiently compelling to warrant a temporary delay in the deployment.

There would be a more formal review of facts, etc., in essence a trial on the merits of the claim which she would ultimately lose because we all know Obama is a natural born American citizen born in Hawaii. It would be interesting to see how the various state bar organizations in which she is a member (based on what I've seen of her someone was taking her bar exams for her) will treat her repeated lies.

She didn't graduate from an accredited law school, so she's not admitted to practice outside California. Maybe she got permission from this one jurisdiction. That was a mistake.

From Wiki:

"Mombasa was part of the state of Zanzibar until 12 December 1963 when it was ceded to be incorporated into the newly independent state of Kenya."

And it is her onus to prove her fake certificate real.

If she doesn't want to go to Iraq, let her stay here. Give her a dishonorable discharge and make her pay for the cost of her education from the time she enlisted, in one lump sum.

31. I doubt it because she came in as a commissioned officer. She could be made to resign
her commission or even be stripped of rank and discharged, but I'm 99% sure she cannot be busted to enlisted rank.

While President Obama would be a US Citizen by virtue of his mother's Citizenship, there's legal uncertainty about whether a Citizen born out of the Country is "Natural Born" as defined by the Constitution.

But, more importantly.....

Have you seen Obama's mother's Birth Certificate? Isn't it her responsibility to prove she was a Citizen when she was alive?

There was a law on the books at the time that in order for your mother to confer citizenship, she had to be 19 years old - Ms. Dunham was a few months short of that. Meaningless because he was born in HI.

They nuts are also using the argument that a natural born citizen is someone who has two citizens as parents. That they are pulling out of their asses - there is no such law.

job requires military clearance, military revokes clearance - no job.

You are right that he had volunteered to go and was able to rescind that choice.

This lady is a dr and is refusing deployment orders.

Antonin Scalia -- who else? -- took up the birthers for a hearing in December 2008, and declared (despondently, I'm sure) that they didn't have a case. Oily Taters is really wearing out her 15 minutes of infamy. But, it's a waste of time and breath to tell those birthers anything else. You see, it's their Religion. The judge pointed out that burden fell on Rhodes because she sought the restraining order to stop her deployment.


In any tribunal system in this country, you make the accusation, you have to prove it. All the other person has to do is defend against the accusation.

But I believe the media's interest will soon increase, once the legal system turns on her at last for having filed these false and frivolous lawsuits.
