Orly Taitz Sanctioned for $20,000

The “Birther queen” has been slapped with a five-figure fine for “wasting the judicial resources” of the Middle District of Georgia, where she’d filed one of her numerous lawsuits demanding that President Obama prove his citizenship before deploying soldiers to Iraq and Afghanistan. The judgment, which calls Taitz’s case and tactics “delusional”:

Counsel Orly Taitz is hereby ordered to pay $20,000.00 to the United States, through the Middle District of Georgia Clerk’s Office, within thirty days of the date of this Order as a sanction for her misconduct in violation of Rule 11 of the Federal Rules of Civil Procedure.

Judge Clay Land makes the toughest statement about Taitz’s antics here:

The Court finds that counsel’s conduct was willful and not merely negligent. It demonstrates bad faith on her part. As an attorney, she is deemed to have known better. She owed a duty to follow the rules and to respect the Court. Counsel’s pattern of conduct conclusively establishes that she did not mistakenly violate a provision of law. She knowingly violated Rule 11. Her response to the Court’s show cause order is breathtaking in its arrogance and borders on delusional. She expresses no contrition or regret regarding her misconduct. To the contrary, she continues her baseless attacks on the Court.

Reached on her cell phone by TPMmuckraker and informed of the $20,000 fine imposed on her by a federal judge this morning, Birther attorney Orly Taitz responded, first, with laughter.

"So he didn't recuse himself?" Taitz asked, after letting out an extended, nervous-sounding chuckle.

Still defiant after months of legal wrangling and, by our count, three written denunciations by federal district court Judge Clay Land, Taitz said she had absolutely no plans to pay the $20,000 fine.

"Are you kidding? Of course not," she said, asked whether she planned to send a check. "This is a form of intimidation."

40. The judge initially warned her he was considering a $10,000 fine
and gave her a chance to show why it should not be imposed against her. I haven't read the article yet but I'm going to guess he doubled the initial fine because she commited more of the same violations in her latest response to the court.

...doubtful that there is anything much that can get her deported UNLESS it is directly related to some sort of fraud by which she entered the US and/or became a citizen.

(7) The court does not make this observation as a rhetorical device for emphasis; the court has actually received correspondence assailing its previous order in which the sender, who, incidentally, challenged the undersigned to a "round of fisticuffs on the courthouse square, asserted that the President is not human."

She's too arrogant and too dumb to appreciate how much trouble she's already in. I don't buy the argument that she's mentally ill, anymore than any other wingnut is mentally ill--I think she's suffering from a bit of a Messiah complex, but aren't they all?

Calling the President a usurper and mocking his father as treacherous and disloyal to the British Crown added nothing to the advancement of Plaintiff’s legal cause ofaction. concerned with teaching you how to pass the CA state bar.

It's a terrible educatonal loophole that CA should be highly motivated to close based on Orly's insane abuse of the system.

antics at that time caused the Court concern, the Court exercised

which she reportedly stated that the Court’s ruling made “absolutely no

From the various responses on that thread he's definitely in complete lockstep with Orly down to where they sound like echos of each other.

While I have no doubt that "Buckhead" of Dan Rather infamy has no love for Obama it appears that he may be one of the more rational ones at least in regards to realizing the damage the birthers (if not just Orly specifically) are doing to conservatives.

Throughout the entire referenced thread there's comment after commment about the judge's obvious bias and how he's in Obama's pocket.

I'd wager that if one dug into voter records that we'd find that Land probably voted for McCain. If there is a bias on Land's end it's a bias for "rule of law" and how one should conduct themselves when presenting a case to the court.

I read the Freeper posts after the judge issued his last statements last week and was surprised to see how many of them realized she was 'delusional'. Apparently this judge agrees.

However, other delusional Freepers mis-read the judge's statements, which set a date for trial, as an order and no one was able to convince them, including people with legal backgrounds, that all that was, was 'house-keeping'. Freepers who now turn out to be right, were called 'trolls', unable to see the 'genius' of O'rly.

It ought to be fun to see their reaction today. I imagine there will be a few demands for apologies.

Seriously though, there really is something wrong with Orly. I think the judge knows it and the next court she appears in, as I'm sure this won't stop her, will probably order a psychiatric evaluation. That might be the only way she gets out of paying the fine.

The judge probably didn't want to order a psychiatric evaluation in this case because he probably knows she then declare herself to be 'living in the Soviet Union' where dissenters were sent away to 're-education' camps.

Freepers are now counting on Judge Carter, having declared Judge Land to be part of the great conspiracy that is covering up for Obama ~ :rofl:

I think they will soon be adding Judge Carter to that list.

The Federal Marshalls will come for her and she'll have the media there. Once imprisoned, she and her supporters will claim that Obama personally signed the arrest warrant and she is a political prisoner and subject to the Geneva Conventions. There will be demonstrations, proclamations and speeches on the floors of Congress.

This is exactly what she wants, short of continuing her lawsuit through the courts system.

I'd be very interested in hearing what sympathies Taitz may have not just for Likud but for Yisrael Beiteinu, and what connections she may have with Soviet-born settlers in the West Bank. As observed above, she is on record saying that Israel's Arab enemies should be "exterminated" rather than merely defeated, and appears to have refused a ride to MSNBC's affiliate in Tel Aviv because she believed the driver to be a Muslim. Like right-wing settlers (see video), Taitz is also fond of calling her critics "nazis" or "brownshirts," as she did with David Schuster in her interview from Tel Aviv. Taitz spoke about her birther activities in a March 1 interview with Israeli National Radio.

Could this be why she has found so much in common with Islamophobic American rednecks who think that Obama is a secret Muslim born in Kenya? Could it also be that America's best interests are not those she has most at heart in her dogged efforts to undermine our president?

He is a Bush appointee and a solid guy. When I was a lawyer we has some interaction.

Today, he threw out Connie Rhodes’s lawsuit. That lawsuit is the one filed claiming Rhodes cannot be deployed to Iraq because Barack Obama is “not constitutionally eligible to act as Commander in Chief of the United States armed forces.”

You do not need a law degree to be admitted to the bar. You need merely pass the bar exam, although it is one of the more difficult ones in the country.

From what I've read the woman is crazy. Crazy people choke up court dockets all over the country. The only reason why she got any national attention is b/c of the teabagger movement which embraced her. And the teabagger movement is lent credence by the GOP establishment.

So, the msm, in the interest of "balance" has given these people far more air time and attention than they deserve. She, the queen of the birthers, is just flat out crazy. We don't give the people mumbling to themselves on the streets any play, so why should she get any? Because she hasn't descended into such utter madness that she's homeless and destitute?

If she fails to pay the fine, which will be upheld, I am quite sure, she will be held in contempt. She will be disbarred. I'm not sure about deportation as I'm no expert in immigration law, but I'm not sure why she'd risk it if she weren't batshit crazy.

The State Bar OCTC (Office of Chief Trial Counsel as if there are subordinate offices) will launch an investigation. Ms. Taitz will undoubtedly ignore their polite request for an explanation, which is further punishable. A rookie mistake. They will then launch a proceeding. Which she will probably ignore. Even if she doesn't, I cannot imagine that they will not choose to beat up on her mercilessly as the administrative system contains no rights for the accused like a criminal system. The minimum sentence will be a six month suspension.

The OCTC is utterly corrupted. Review the case of Benjamin Fields, Santa Clara County Deputy DA. He got five years suspension (one stayed!) for diddling with the evidence in multiple criminal cases. This was as serious as any case the OCTC has every put before the State Bar Court. There were multiple incidents. It should have been disbarment. They only asked for 3 years suspension. He has the chutzpah to appeal it. Hopefully the appeal court (which I have not practiced in front of) will disbar him. They have authority to increase the sentence.

I'm not familiar with Benjamin Fields, but with drespect to evidence diddling (a felony),
usually that job is left to alert police officers, not the DA. Still, the strength of
the evidence of 'diddling' might be slight and that would bear on the Fields discipline.
This is not, on its face, strong evidence of corruption of OCTC. However, you seem more
familiar with circumstances of the Fields case so I leave it to you.

Oily will get her disciplinary hearing, I am confident. She is, after all, a CA lawyer
who is pro hacking around the countryside, without client and in apparent reckless disregard
of law or the rights of others. Oh, btw, the guy writing her frivolous pleadings.. he's also a
disbarred CA lawyer. So at least we know some lawyers get disbarred in CA.

Recall Orly has multiple complaints and admonishments by the Fed courts, and the Bar
will be considering those also, along with a $20,000 sanction (!) which just has to be
rare, one might hope.

Personally, I think she needs a psych eval. Her "supporters" are funding her as long as she
is center stage, so she probably isn't worried about $20,000. Appealing it will just keep her
fund raising going. This is a reoccurring tactic of the right... consider John Ashcroft,
repeatedly admonished for bad faith litigation, for example.

When the judge tossed the case, and asked Orly to explain why he shouldn't hit her for $10K for frivolity, her client quickly bailed while Orly filed a motion for reconsideration, a motion apparently intended to continue the case without her client, and a motion asking the judge to recuse himself on the grounds that: (1) he was a traitor and (2) must have had ex parte communications with Eric Holder (based on somebody's "I think I saw somebody who reminded me of Eric Holder in a Georgia coffee shop one day" affidavit) and (3) had a corrupt financial interest in the outcome of case, due to his holding of Microsoft stock :eyes:

Starts off by announcing Judge Land decided against her because he is "CORRUPT." I can only think that will enhance her penalties. Airs again at 12:00. She also held up Judge Carter's scheduling order and announced that meant her case would go to jury trial, which is completely FALSE, it merely sets forth the schedule IN CASE the case goes to trial, but in no way orders a trial. It's amazing how easily she ignore small impediments such as FACTS.

181. it's funny that repubs decide when they will adhere to legal rulings and when they will not ...
... and they call themselves patriotic ...if it wasn't tragic, the behavior of republicans would be really funny!

100 years from now, historians, kids and general citizens would wonder whether republicans were the figment of imagination or whether such lowly folks really existed.
