Pa. swim club accused of bias to file bankruptcy

PHILADELPHIA — A suburban swim club accused of discrimination last summer after revoking the memberships of mostly black and Hispanic children plans to declare bankruptcy, a newspaper reported Saturday.

Valley Swim Club president John Duesler sent an e-mail to club "friends and families" Friday saying the board of directors had voted to file for Chapter 7 bankruptcy this week, The Philadelphia Daily News reported.

Duesler wrote in the e-mail that many would blame the bankruptcy on legal proceedings and negative media exposure, the newspaper said. But, he said, "the truth is that the club has struggled to stay out of the red for at least the last decade" and owes more than $100,000 in operational expenses and legal fees, the newspaper reported.

Duesler declined to comment to The Associated Press on Saturday.

7. Could they be doing this to avoid paying a civil judgment?
If the kids/families sue and prevail at trial, the club would be liable for damages. If they are in chapter 7, that would void the ability of the claimants to collect I think (not too familiar with bankruptcy law -- work in other legal fields).

18. I was thinking along those lines too.
1) Club goes bankrupt.
2) Lawsuit goes away.
3) Rich members buy the club and re-open it "under new management."

21. It would be ironic and fitting
If the city and town the club is in buys up the facility and opens up to all people to come to. I'm sure it's a nice facility and would be a good addition to the city resources, and between volunteers and stimulus money, probably wouldn't be all that expensive to run, since everybody could come and pay a fee instead of a few snobby members.

Then the kids could come back and swim to their heart's content.

Like the bankruptcy of KMart, GM, CIT?

A good way to rid the company of pesky debt, emerge as a so-called "new" company, and continue business-as-usual?
