Court Martial Charges Brought Against Birther Army Doc
Source: TalkingPointsMemo.com

Formal court martial charges have been brought against Lt. Col. Terrence Lakin, the Army doctor who believes President Obama may not be a natural born citizen, for failing to follow orders, the military said today.

Lakin was charged Thursday "with one specification of a violation of Article 87, Missing Movement and four specifications of a violation of Article 92 (three specifications of Failure to Obey a Lawful Order, and one Specification of Dereliction of Duty)," said Chuck Dasey, spokesman at Walter Reed Army Medical Center in Washington, where Lakin is assigned.

The court martial is likely to raise the prominence of what is already a cause célèbre among Birther adherents.

Late last month, Lakin released a YouTube video in which he explained that he would not report for a second tour in Afghanistan until Obama proves he is a citizen. A couple of weeks later, the Army announced he was under investigation.

11. No...
He is essentially claiming illegal order and those orders were from a legitimate chain of command. To recognize any part of this challenge would destroy military cohesion as ANYONE could be challenged for ANY order.

The cost to the individual of such a failed challenge is also high for a reason.

He is about to get stomped. He will be celebrated as a hero by the Teacessionists.

12. I don't know the answer, but Lakin wouldn't go that route anyway
If he's let it go this far, it looks like he'll go all the way with this--and he'd never claim that his position is insane. There may be delusions of grandeur there, if he's trying to be some kind of teabagger hero. But that's just a common, everyday affliction these days, with so many people willing to do just about anything to attain celebrity. :eyes:

9. Did we pay for...
...any of this SOB's medical education? Get it back, with interest...and while we're at it, deny him the right to practice medicine anywhere in the US for, oh, say five years or so. I mean Doctors that 'pull out early' from their contracts are routinely held to a 'non-compete' agreement. Point is, make this kind of crap 'cost-prohibitive' rather than an easy way to get out of his obligations.

The Congress of the US certified the election. No soldier has the right to challenge that.

16. Nuremberg trials
You are missing the point.

A lot of Germans were convicted of war crimes for "lawful" orders. So could he be liable?

Shame to loose a good soldier. Could be possible Moral Delima, follow orders then be convicted for doing them.

He should not have to force the issue, the information by congress is validated.

Unfortunately for him, he disobeyed a lawful order empowered by the president to deploy. He can be real dead meat shortly.

17. Not To Put Too Fine A Point On It, Sir, That Is A Pile Of Barnyard Effluent....
People were convicted at Nuremberg for obeying orders that directed actions contrary to recognized international law.

The concept has no relation whatever to the nonesensical and racist pretense that President Obama is not actually President of the United States, and therefore no order in the military of which he is commander in chief is lawful. There is no question of a moral dilemma here, unless you consider it a moral dilemma that a white should obey orders tracing up a chain of authority to a black man.

19. Why is it that Lakin won't serve in Afghanistan, and yet is willing to report to Walter Reed?
And before this controversy he was reporting to the Pentagon. Does he have a legitimate Commander in Chief for stateside duty, and an evil Commander in Chief from a parallel universe for the Afghanistan theater?

22. Give him a felony conviction
Good. Give him a felony conviction, take away his medical license and send him on his way. All that hard work to become a Doctor thrown away over a stupid political gesture. I am sure he can entertain his co-workers at McDonalds with his tale. :)

And apology to any McDonalds workers out there
