16. Beam Me Up
Kagan's a kreep, but so is Sotomayor. If it's Kagan, corporations will cement their rule over the SC and there will be no looking back. Legally, it will be curtains for what tiny, scattered bits of democracy remain in this place.

But there's always a silver lining: during the confirmation hearings, people can sell t-shirts that read "If Thurgood Marshall were here, he'd smack you in the head."

4. If it's anyone but Kagan, I'll eat my hat.
I've never before heard of an administration putting out talking points in defense of someone who wasn't even the named nominee yet. It's her.

6. They've made their selection perfectly clear, haven't they?
Plus Kagan's too well-connected to be passed over twice for the SC.

9. No kidding, plus she'll be on the bench for a long time.
Unfortunately, we can no longer afford the luxury of picking seasoned jurists with decades of decisions behind them. The right picks young, relatively unqualified corporatist and religious ideologues who poison the court for decades.

We have to play their game.

17. Anyone got the TV on?
Edited on Sun May-09-10 09:16 PM by Tx4obama
It's all over Twitter that NBC has confirmed that it is Kagan.
Is that true?

Also from Twitter:

@chucktodd: NBC's Pete Williams: Elena Kagan is POTUS' pick to replace Justice Stevens, making her 4th woman ever on #scotus

Edited to add:
CNN is doing a big Breaking News report now on Kagan.

20. SEVEN republicans
Seven Republicans voted to confirm her (Kagan) as solicitor general.

Coburn (OK), Collins (ME), Gregg (NH), Hatch (UT), Kyl (AZ), Lugar (IN), Snowe (ME).

Newly minted Democratic Sen. Arlen Specter voted against her.

21. Obama's NEXT one AFTER Kagan
Since President Obama has been in office for less than one & a half years, and will more than likely be in office for a total of eight years, I am hoping that his next (3rd) nomination will be Harold Koh ;)
He'll probably pick a 'male' next time and Koh would be perfect!
