Panel: Yucca Mountain waste dump process continues

A Nuclear Regulatory Commission legal panel says the federal Department of Energy can't withdraw its application to build a national nuclear waste dump in Nevada.

The NRC's Atomic Safety and Licensing Board ruled Tuesday that Congress directed the DOE to file an application for the Yucca Mountain repository, and directed the NRC to consider it.

It says letting the department "single-handedly derail" the process would be "contrary to congressional intent."

The NRC legal panel held hearings on the issue earlier this month in Las Vegas.

1. Those NRC bastards won't take "No" for an answer. will they?
How many of them are Republican appointees? - Mainly Bush? Dump the crap on their front porches - let them fight the radioactivity.

3. I hate to say it, but the NRC has a point here.
Congress directed these two agencies to do something, and they can't simply say "No" because they want to. The Nuclear Waste Policy Act, passed by Congress and signed by Reagan, directed the agency to pursue the project. Neither President Obama or a bureaucratic agency has the right or power to overrule that act.

Instead of trying to push this off onto bureaucratic lackeys, Congress needs to amend its original order and send the President a bill that will abandon Yucca Mountain for good. We have the votes, the Republicans aren't going to waste a filibuster on something like this, and Obama will sign it. Someone get this introduced, quick!
