Sharron Angle: We're going to "pursue" Harry Reid for reposting my Web site -- possibly in court
Edited on Wed Jul-07-10 11:18 PM by TomCADem
Source: Washington Post

Now that the Harry Reid campaign has reposted Sharron Angle's previous campaign Web site advertising her Tea Partying positions, Angle may be heading to court to stop him.

That's what Angle said on a Nevada radio station this morning. Asked by her host whether she intends to pursue Reid in court, Angle said: "We are going to pursue it. I don't think that Harry is above the law."

In case you missed the whole backstory, after Angle won the primary she replaced her old campaign Web site with a new one featuring toned-down versions of her previous positions. The Reid campaign, hoping to draw attention to her Tea Partying, posted a reconstituted version of her old site. Angle responded with a cease and desist request, which Reid's camp at first agreed to, before reposting her site last night.

* * *

"Well your website is like you, it's your intellectual property," Angle said. "So they can't use something that's yours, intellectual property, unless they pay you for it or get your permission... And he didn't ask me for it, and he didn't pay me for it. I would have sold it to him."

Well, I never thought of using an intellectual property argument to prevent an opponent for quoting stupid things a politician has said or written. Who needs the First Amendment? Oh wait, according to the Supreme Court, only corporations who get to spend unlimited sums.

Finally, can you imagine if you had to pay royalties for quoting the stupid things a politician has said? Sarah Palin would be richer than billionaire Meg Whitman!

Like Sara Palin, ethical concepts are only for those smart and liberal enough to care.

I'm sure her tea-party base will actually embrace Ms. Angle even closer.

Except her "tea party base" is very small compared to the rest of the country.

Nevada.... another one of those big empty "heartland" states that survive off the populated "blue" coastal states. I say, let'em go Teabagger.... and take away all that "socialist" money. Let Las Vegas support the whole desert state!

93. Las Vegas is blue, thanks.
Like many states, Nevada is divided - more conservative in the north and rural areas, very liberal in the south. It's a close call, in terms of votes - in the last two presidential elections the conservatives won by only 1 or 2 percentage points; hardly a landslide. I'm not sure why you're so comfortable painting with such a broad brush; I guess it easier than doing any sort of research.

10. I was refering to her having no intellect
But as far as Reid being able to repost the website I have no problem with that.

I look at it as a verbal and written contract between her and the voters.
She is stating what she is promising to work towards if the voters vote for her.
In my view that is a contract, legal and binding. If she changes her mind after the vote
then that is fraud and she should be sued on those grounds.

12. Wouldn't that also apply to her using anything that Harry Reid has done or said in his capacity
as Senator or in his campaign?

The problem I see with her argument is that she would be considered a public figure both as a former state legislator and U.S. Senate candidate. Wouldn't all or most of what was on her previous website had been reported via the media? If so, then by her argument what they printed or telecasted would also fall under intellectual property and a violation.

She is a damn fool. But fortunately for Harry Reid he should be able to put it out in the public that Angle wants her base to know that she is a Tea Baggers but doesn't want the other voters to know how wacky she is. And that she is either lying to the Tea Baggers (unlikely) or to everyone else.

Like another poster said upthread, she is obviously using the Palin playbook. She may not be smart, but she is appealing to people even less smart than she is by saying "look at the sneering liberals looking down their noses at good, honest God-fearing folk like you and me. Who you gonna vote for, Whitey, me or them?"

60. They don't think they need them
In their mythology, the Tea Party types represent the great silent majority that is waiting to rise up and overthrow godless liberalism once and for all. By remaining pure and not compromising with evil, they can tap into America's innate fascismconservatism and achieve victory with only their base (aka "99% of right-thinking people")voting for them.

84. Aw, c'mon. Republicans don't have to answer to no SINKIN facts.

Say you're running against a Republican.

Okay, who cares about facts?

F'rinstance:

Ask the Republican:

"What's the difference between a duck?"

You think the Republican has no answer?

WRONG-O.

Here's how the Republican will answer:

"One of its legs are both the same."

And the follow up answer is:

"Quack."

But that's okay because Republicans don't need to adhere to facts.

They're above that.

seems to work for Republicans and against Democrats doesn't bode well for Harry. It's a double standard for sure, but claiming that the evil "Librul Media" favors Obama worked, even to the point that most DUers believed that bullshit. Now the evil LIBRUL MEDIA is after poor, little, sweet Sharron Angle. That claim put Palin on the map; it may work for Angle if she plays her cards right.

After all, incredibly she's LEADING Harry Reid, even after every idiotic thing that has come out of her mouth. Only now does Harry want to grow some balls and fight? We could have used *this* Harry Reid in the Senate.

No....
The choosing of her for VP put her on the map. The rest is just residue.

And the Judge doesn't care about public opinion (or shouldn't). Reid merely has to ask why voters should be blocked from knowing she has changed her positions.

98. I disagree, again, on the first point. Yes, choosing her for VP put her on the map; however,
we Democrats are badly underestimating the appeal of this woman. The M$M is obsessed with her, and they are putting a narrative out there that she is formidable.

On the latter point, we agree. Of course public opinion shouldn't matter, and yet remember that lower courts are filled with conservative-leaning judges, many of who were put in place by Bush.

I'm sorry for being such a Debbie Downer, but I have absolutely NO faith in the average American voter. The fact that Sharron Angle is beating Harry Reid shouldn't be glossed over. It says something about the voting electorate, about how uninformed, backwards, and utterly apathetic this country really is.

They think just like this, but how many others will? I've got to think, this isn't the only deceptive, innovative stupidity she will do.

Her lead might be peaking here. There might be a "protest" vote against Reid, but she seems capable of spinning gold into straw. She'll turn that protest vote into a protest boycott, and generate a boycott against herself.

Something you said to someone who told it to someone who blogged it to someone 10 years ago is probably still cached on the Internet. So when it comes to your "old Web site," you're SOL, Lady.

Which is as it should be. This kind of stuff ... this is what the Internet is for. So you can't hide from your flippity-floppity statements of the recent past.

35. She might have a case if it was HACKED. It wasn't.
However, reposting a web site is no big deal. I suspect the new web site is every bit as much the intellectual property of its owners as her new web site is.

One is quite welcome to post any information, misinformation, or outright lies on a web site as one wants. So if she put her idiocies up for worldwide viewing, somebody else can, too. I can put up my own blog and insist that I'm really a dog who will be buying NASA in August so I can fly to Mars. Later, I can take it down and put something more reasonable there, but if someone remembers or has screen shots or even the code from the original, and chooses to post it, it's not theft of intellectual property. It's proof of previous posting.

Angle saying someone using material she removed is theft is not different from saying that someone who looks up anything in any Internet archive is a thief. Sorry, Ma'am. Incorrect.

36. I wonder if they'll sue
I wonder if they would also sue http://web.archive.org/web/*/http://sharronangle.com/ for also copying her previous pages.... MANY of them actually. As does google cache.. what, should google be sued now too?

Where do I sign up for this special license that permits me to mirror a web page. I had no idea it was illegal, nor was I aware that people have copyright's to their stump speechs and web site promo talking points.

Can I get that package added to my Time Warner cable internet?

Either I've been left in the dark, or this is the most pathetic excuse and taunt of a lawsuit I have ever seen.

Makes me wonder if she could also sue a legion of free web server host sites also carrying mirrors of her old site.

39. I see where this will go
If Angle got away with this I see where it would go. I'm sure the Reid camp posted the web site verbatim so that there would be no question that it was her words and her positions as stated on that site. If she could have or does get them to pull it down then it would allow her to claim that 'I didn't say that' or 'that was taken out of context' whenever her own words are brought up. Of course, in someways this is giving her credit for being smart and I really doubt that is the case.

46. The spin is - Sharon why are you so ashamed of your website?
Why don't you want people to see what you openly posted as your campaign positions? What do you have to hide? It is your OWN website after all?

It was published openly as campaign material without membership or payment to see it. It is a historical document as far as I am concerned. Does she think reporters can't access and report on her own voluntarily published positions.

It would be great to see headlines like

Angle sues Reid to keep her own website from the light of day.

Go Sharon! Every day you top your own stupidity. Keep making your own website an issue.

...that affect all of us, and she doesn't even understand the most basic concepts regarding the internet, copyright, fair use, etc?!?

I know it seems amusing, the Sarah Palin comparisons and all the jokey fun stuff, but this woman and her ilk are dangerous and must be stopped. These people are leading us into Idiocracy, and the fact that so many of these types can get nominated does not bode well for our society...

97. websites posted on the Internet are not in the public domain
I'm pretty sure that Skinner wouldn't stand by idly if someone copied all of DU's content and posted it under a different URL.

That being said, SharronA is an idiot because the particular use of her old site in all likelihood meets the standard of fair use and because making an issue of its reposting only draws more attention to something her handlers apparently realized was better off buried.

77. She is clueless isn't she?
First, it will make these comments of hers even more famous.

Second, she will lose. First amendment. It is legal to post excerpts for a long list of purposes. Lawyers will have a field day.

Third, it will make her look like someone who does not take credits for her acts and words, therefore unfit to serve.

79. regarding her whole campaign:
in a state where loose morales and excess are the mainstay of their economy (ie: Vegas, Reno, Tahoe). If she really thinks that those mega corps that own those towns are going to let her win and 'ban beer' and other spirits, and allow her to create a mini theocracy in it's place........she is officially more bat shit crazy than Bachman or Palin put together. The Casinos and Resorts will bury her before they let her mess with what they've got going.

Please democrats VOTE democratic this november so we can soundly defeat the rising tide of embarrassing idiocy.
