Muslim Army chaplain appeals adultery, pornography reprimands

MIAMI - A Muslim chaplain once suspected of being involved in an espionage ring at the Guantanamo Bay prison for terrorism suspects has appealed his reprimand for committing adultery and downloading pornography onto an Army computer.

Capt. James Yee, 35, was issued a reprimand last week during an Article 15 proceeding, used by the Army to settle minor disciplinary issues. Yee's lawyer submitted the appeal Sunday.

Eugene Fidell, Yee's attorney, wrote that "a grave miscarriage of justice has occurred. Decisions were made on insufficient evidence, and have had devastating effects."

Fidell contends the Army failed to give his client an adequate amount of time to prepare for the proceeding and the adultery allegation only emerged because of the military's investigation into the espionage case.
