Kucinich Wants To Visit Wikileaks Suspect At Brig

Ohio congressman Dennis Kucinich has asked the Defense Secretary Robert Gates for a visit with an Army private suspected of giving classified material to WikiLeaks.

Kucinich, a Democrat who is a member of the House Committee on Oversight and Government Reform, sent a letter Friday to Gates asking for a visit with Pfc. Bradley Manning.

Kucinich says he is concerned about reports of Manning's treatment while in custody. Manning's lawyer has filed a complaint with the Quantico commander about the conditions Manning is being held under.

Why did Kucinich have to sue? The cafeteria should have had insurance to cover its loss. Kucinich had a right to have his damages covered. Where was the cafeteria's insurance company? Was the company trying to make a political point by refusing coverage for Kucinich's damages?

A lot of people here have never apparently worked in a food service job.

Here's how it works - the cafeteria buys a 5-lb. can of pitted olives from a cafeteria supplier. Olives in a service receptacle where the salads are made are replenished occasionally from the can, as the need arises. Cooks in the cafeteria grab a small handful (with plastic gloves on their hands) and put them on salads.

The olives are pitted by running them through a machine. The machine isn't perfect; every so often an olive misses the pitter.

Unless the workers inspect every olive individually it is impossible to guarantee that one won't slip by (correction - it is possible, but the salad would cost twice as much and no one would buy them).

87. The restaurant IS responsible to the injured customer. Here's why.
The common law in the land is that an innocent injured party who has done nothing wrong, has a relationship of sorts with a seller of goods. If the customer gets injured through no fault of his own, but because of an item the seller sells him, then that seller is responsible. Otherwise, the injured party has the burden of the suffering and medical costs for something that he was totally not at fault. AND, the customer was not the one who had a relationship with the original marketer of the olives. The seller had the relationship and/or contract with the original marketer, and was the one charged with choosing a reputable marketer and with inspecting the olives before serving them to customers.

So the seller is responsible to teh injured customer. BUT if the seller thinks it's the marketer's fault, he has the right (and the cost burden) to turn around and seek reimbursement from the marketer.

That's the way it usually works. That's because the customer has no business relationship with the marketer, didn't have a duty to inspect the olives, doesn't have prior history knowledge about whether there have been prior problems with the olives, what can or jar the olives came in (for product #), etc., etc. All that knowledge is in the hands of the seller....the one who had the relationship with the original olive marketer.

That's the way it usually works. If I had to guess, the seller didn't recompense Kucinich because they doubted the olive was the cause of it...he'd waited a long time before demanding $ for it, and the bills were so high that it seemed doubtful all that came from one olive pit (I'm guessing they thought). OR they didn't consult an attorney, who would've told them they're responsible.

Still, Kucinich is a very wealthy man. I'm surprised he let this go public, instead of just footing the bill himself. It harmed his reputation, I think. Although he had every right to demand compensation. Still, the fact that someone has the right to do something doesn't mean it's the right thing to do.

To me, legal responsibility is irrelevant in a case like this. There is a huge class of misfortunes where *from a practical standpoint* absolutely no one is at fault, and no one has done anything wrong.

If a meteor falls from the sky and destroys my car, I've done absolutely nothing wrong. I can sue the federal government for not scanning the skies 24/7 for objects which may harm me or my property, but it's hardly reasonable for me to assume the federal government has the resources to do this. So if I'm not willing to risk that (admittedly remote) possibility I can perhaps park my car in an underground garage or buy insurance.

Similarly, it's hardly a reasonable assumption that cafeteria workers inspect every olive to be sure it's been properly pitted. What if it went through the pitter, but a pit fragment is left over - should we require x-ray scans of olives prior to being served? In this case, unlike the meteor example, we actually have far more reason to blame Dennis himself for the losses from his injury. He either has lousy dental hygiene or a genetic predisposition to tooth decay, and in both cases he should have bought dental insurance.

"Still, the fact that someone has the right to do something doesn't mean it's the right thing to do." This sounds like a paradox, but it isn't really - you're comparing legal right to ethical or moral right, and with that statement I'd agree 100%.

Kucinich has credited his Catholic upbringing with helping to form his social conscience and Catholics are taught that "visiting the imprisoned" is an Act of Mercy.

I know a lot of Catholics (including those of us no longer practicing) who credit the nuns for making us liberal by pounding the Acts of Mercy into our heads.

I have no doubt this Administration to save it's own face and that of it's predecessor that was unveiled through WikiLeaks is subjecting this man to torture. It seems to be a Bush-Obama fantasy fetish. I once thought, as a naive young man, that our nation stood for principles like innocent until proven guilty. But we are in many ways no better than the torturers of Cairo. I have no doubt that this man has been subjected to torture under international conventions to which the U.S. is a signatory.

I feel shame for this nation..............

I mean seriously, Manning is accused of a crime, but solitary confinement pre-trial? No news? No books? All that seems WAY too much for someone with merely charges, not convictions. And isn't that even worse than those Guantanamo detainees who don't even have a single criminal charge on them?

Meanwhile, the perps of the horrible things that Manning allegedly exposed still walk free.

48. Sometimes I think Kucinich is our only hope. And as for the lawsuit,
I can sympathize. I've been through the same nightmare due to an unexpectedly hard object in restaurant ice cream. It's been an ordeal of pain and expenditures ever since. Didn't he initially just ask for restitution and the restaurant refused? Kucinich is not a wealthy man and teeth problems can run into thousands of dollars. Dental insurance? Pfft. It's a joke.
