Wisconsin court set to hearing arguments in union suit
Associated Press

Updated: 06/06/2011 07:27:15 AM CDT

The state Supreme Court is scheduled to hear arguments this morning on whether it should decide if Republicans violated Wisconsin's open meetings law as they passed Gov. Scott Walker's contentious collective bargaining law.

Dane County District Attorney Ismael Ozanne, a Democrat, filed a lawsuit in March alleging GOP legislators convened a committee meeting without the proper public notice moments before the state Senate passed the measure. Judge Maryann Sumi blocked the law from taking effect while she considered the case and last week declared the law void. ....................

1. The forgone conclusion is that the legislature did no wrong.

2. It's the system we have & as discomforting as arguing before a partisan court
is, it must be done distrust or no.

The lawsuit has been an uphill slog against republican opposition and Ozanne has pushed it this far. I suppose we should remain hopeful. But the weather this morning--dark rainy--sort of matches the grime tone of my thoughts going into this.

3. If this were a "normal" case...
the Supreme Court would only decide to hear the case if the losing side appealed on the basis of a mistake of law or a mistake in process of the lower court.

Although Sumi was PAINFULLY careful with her rulings and process, the DOJ may appeal on the basis of "immunity" and "improper service". The Assistant Attorney General defending the case ranted ad nauseum on those two issues during the trial and Sumi routinely over-ruled her objections.

This is needles and pins time...although the court would have to jump through some pretty strange hoops to make it happen...which would make Prosser look like a political hack.....

oh wait....

9. I noticed that, too.
Since this is LBN, is assume the headline is posted exactly as written.

Blame the reporter. We are producing semi-illiterates and allowing them to write newspaper stories.

7. Not too hopeful
Prosser's re-election almost certifies a loss for the union. He even said during the election he wanted to get back on the court so he could do Walker's bidding.

8. The FBI should be crawling all over Walker's crew of crooks.
The DOJ is asleep at the wheel again. Elections are about as fair here as they are in Afghanistan.
