Global arrest warrant issued for Qaddafi, son

The International Criminal Court on Monday issued arrest warrants for Libyan leader Muammar al Qaddafi, his son Saif al Islam Qaddafi, and Libya's head of intelligence, Abdullah Al-Senussi, who is Qaddafi's brother-in-law, for war crimes and crimes against humanity.

The warrants name Qaddafi for the commission of two categories of crimes against humanity: Murder under Article 7(1)(a) of the Rome Statute, and persecution of crimes against humanity under Article 7(1)(h) of the Rome Statute.

The court's move comes on the 101st day of aerial bombardment by NATO warplanes and helicopters of "command and control" sites belonging to Qaddafi's regime - a limited military campaign which has enabled the nation's rebel movement to hold their ground, but advance very little on the regime's strongholds.

The ruling was made by three pre-trial Judges based on a lengthy request by the court's chief prosecutor, Luis Moreno-Ocampo, submitted to the Court in mid-May.

The I.C.C. does not have enforcement power, but the court, based in The Hague, Netherlands, has already requested that Libyan authorities arrest those who are indicted, even though Libya is not a signatory of the Rome Statute, which establishes the Court's jurisdiction

The International Criminal Court in The Hague today issued an arrest warrant for Libyan leader Moammar Gadhafi.

The court also issued warrant for Gadhafi's son and intelligence chief.

The charges cover alleged crimes since the latest popular uprising, the Associated Press reports.

Among the charges against Gadhafi: orchestrating the killing, injuring, arrest and imprisonment of hundreds of civilians during the first 12 days of the uprising and for trying to cover up the alleged crimes.

The International Criminal Court issued arrest warrants Monday for Libyan leader Moammar Gadhafi and two of his relatives.

ICC Judge Sanji Mmasenono Monageng read the decision Monday to issue warrants for Gadhafi, his son Saif al-Islam Gadhafi and brother-in-law Abdullah al-Sanussi. Al-Islam Gadhafi is a close adviser to his father, while al-Sanussi serves as Gadhafi's head of intelligence.

The warrants are "for crimes against humanity," including murder and persecution, "allegedly committed across Libya" from Feb. 15 through "at least" Feb. 28, "through the state apparatus and security forces," the court said in a news release.

In Misrata, a critical city for Libyan rebels in which fighting has raged, a crowd cheered Monday following the news from the court in The Hague.

The three-judge Pre-Trial Chamber I at The Hague found "reasonable grounds to believe that the three suspects committed the alleged crimes and that their arrests appear necessary in order to ensure their appearances before the court," the written announcement said. The court also believes the warrants are needed to ensure that the three "do not continue to obstruct and endanger the court's investigations; and to prevent them from using their powers to continue the commission of crimes within the jurisdiction of the court."

Inevitably, whenever something's posted about Gaddafi's crimes, someone has to make this reference, regardless of the credibility of the source. Thought that I'd try to short-circuit this.

The chief prosecutor of the International Criminal Court has urged Muammar Gaddafi's own aides to arrest the Libyan leader and turn him over for trial on murder and persecution charges.

Luis Moreno-Ocampo said Gaddafi's inner circle had to decide whether to be part of the problem or part of the solution in Libya.

His appeal on Tuesday came the day after the court issued arrest warrants for Gaddafi, his son, Saif al-Islam, and the country's intelligence chief, Abdullah al-Senussi, for alleged crimes against humanity.

"Justice will be done in Libya," Moreno-Ocampo told reporters at the court's Hague headquarters in the Netherlands.

8. I was thinking that, too. Cheney/Bush are probably more guilty of war crimes and assorted atrocities
than anyone alive today. How come the ICC doesn't address that?

Why weren't those bloody murderers in white ruled South Africa brought before the court,why isn't BiBi indicted?"Justice delayed is just another plow used by western enablers to protect their own criminals.

Human Rights Watch says the warrants issued by the ICC have sent a strong message to abusive leaders. The group also says that concerns the warrant against Gaddafi will act as an obstacle to finding a solution to the conflict in Libya are misguided as it is unlikely that there is a connection between the ICC investigation and Gaddafi's refusal to step down.


International justice director, Richard Dicker, said:



Muammar Gaddafi already made clear he intended to stay until the bitter end before the ICC process was set in motion, and his son's February vow to 'live and die in Libya' speaks for itself. It beggars belief that a dictator who has gripped power for over 40 years would be frozen in place by this arrest warrant ...


As a judicial undertaking, the court's work is distinct from the military and diplomatic initiatives unfolding in Libya and it would be a mistake to conflate them. Justice, to be credible, must run its independent course."
