DOJ Files Lawsuit Against Alabama Immigration Law

The Department of Justice has filed a lawsuit challenging Alabama's immigration crackdown, arguing that the law is unconstitutional because it interferes with federal enforcement of immigration policies.

The DOJ has asked the courts to grant a preliminary injunction against the law, which is scheduled to go into effect September 1st, because it will cause "irreparable harm" if allowed to stand until the law can work its way through the court system.

The law, which makes it a crime to be an illegal immigrant in the state, among other things, was passed by the state legislature in June.

In a press release, the DOJ writes compares Alabama's law with that of Arizona, which it also has challenged in court. "Alabama's law is designed to affect virtually every aspect of an unauthorized immigrant's daily life, from employment to housing to transportation to entering into and enforcing contracts to going to school."

So, let me get this right. The DOJ will file a complaint arguing that legislation which makes it illegal to be a criminal is in fact, un-Constitutional.:crazy:

Right off the top of my head, I'd say the budget cuts that are being debated, should include some cuts in the DOJ's budget.

2. It is not that it is illegal to be a criminal. It is that this type of legislation...
...criminalises virtually ALL ACTIONS surrounding these individuals.

Feed or house one you're a crim. Offer them medical care, that's a crime too. May not be able to stop them going to school thanks to the pesky feds and their human rights, but damnfersure it would be a crime to give them text books, and other education supplies. With no driver's lisences and a public transport system that's an immigration trap, getting about safely becomes all but impossible.

4. as long as ICE continues enforcing the law this is alright
I can't believe that so many people on the right ignore the facts: deportations have increased during the 2000s especially under Obama, and illegal immigration declined during the second half of the 2000s. Enforcing the law is one thing, intimidating friends of illegal/undocumented immigrants is another.
