A Tea Party group's lawsuit attempting to dump the new map that sets the boundaries for New Jersey's 40 legislative districts will probably be dismissed, a state judge said Thursday.
State Superior Court Judge Linda R. Feinberg said she's likely to grant a motion by the commission that redrew the districts to toss the lawsuit by the Bayshore Tea Party, but will not make an official ruling until next week.
"My initial feeling is to grant the application
, but it would be unfair to the plaintiffs, or really all the parties, for me to call it today," said Feinberg, who sits in Mercer County. "I want to review my notes, the briefs that have been filed, the comments that were made here today, but I want to do it quickly."
The 10-count suit, filed in April, claims the new map is unconstitutional because South Jersey districts tend to have more residents than North Jersey districts and nobody on the commission represented unaffiliated and third-party voters. It also argues that counties are split many more times than necessary, and Newark's and Jersey City's clout was diluted largely because they would each go from three legislative districts to two.
