TransCanada raises lawsuit threat (oil sand pipeline)

LINCOLN — Nebraska legislation regulating the Keystone XL pipeline's route could run afoul of both the federal and state constitutions, according to a legal analysis sent to state lawmakers by a TransCanada lobbyist.

But State Sen. Annette Dubas of Fullerton said Tuesday she is confident that the Legislature can craft and pass a bill that would withstand legal challenges.

"We are in the early stages of development, and I look forward to your input," she said in an email to colleagues.

TransCanada lobbyist Joe Kohout sent out the analysis within hours after Dubas circulated draft legislation that would require state approval for large oil pipelines crossing the state.

1. A complaint will be filed with the NAFTA Dispute Resolution panel and the state law(s) will be
overturned on the grounds that they are trade restrictive and thus a violation of NAFTA. It's also a safe bet that the Obama administration will pressure the hell out of the Nebraska legislature to kill the bill.

2. I think they should circumvent the farmlands of the Middle West
where the pipeline could do a lot of damage, cross Canada and come down through Montana, Wyoming, maybe Utah, Arizona and then where they want to go through Mexico or Texas. Those are conservative states that will welcome the pipeline. And they don't have vulnerable farmlands.

I do not want to see a pipeline going through our farmlands. That is a horrible idea. It's a disaster waiting to happen.

Besides, Max Baucus would surely welcome all those jobs.

3. Montana and Wyoming... Yellowstone caldera location... Wonder what an oil
pipeline would add to that scenario? :scared:

4. In the scale of things, absolutely nothing.
It's still a crap idea but a pipeline failure would be truly dwarfed into
insignificance by a Yellowstone caldera event ...

6. Same as for anywhere else: a toxic mess created purely for greed (business as usual really ...)
Sorry about the previous, I assumed that by mentioning Yellowstone
you were meaning to link the "everyday" toxic pollution effects with
the "earth-shattering" super-volcano effects.

Yes, it would be pretty bad to have a "normal" pipeline failure
in such a beautiful place but - as we've seen so many times - that
is absolutely no impediment to the plutocracy's plans.
