BREAKING NEWS: Ohio votes to overturn (ISSUE 2) new collective bargaining law

Reporting from Washington and Columbus, Ohio—
Ohioans voted Tuesday to overturn the state's new law limiting collective bargaining rights for public employees, a victory for organized labor and their Democratic allies in the key electoral battleground.

With 25% of precincts reporting, the "no" votes for Issue 2 -- votes for repealing Senate Bill 5 -- had a 63-37% advantage. The Associated Press called the race at 9:16 pm ET.

The vote marks a setback for Ohio Gov. John Kasich who, along with other newly-elected Republicans this year, sought to limit public sector workers' ability to collectively bargain. A similar effort in Wisconsin spurred a slate of recall elections of Republican state senators, and another potentially coming next year targeting Gov. Scott Walker himself.

A union-financed petition drive put the measure on the Ohio ballot this spring shortly after Kasich enacted the law. The contest over the initiative was perhaps this fall’s most expensive, and closely watched, fight.

COLUMBUS — Ohio’s new law limiting the collective bargaining abilities of 350,000 unionized public workers has been defeated after an expensive union-backed campaign that pitted firefighters, police officers and teachers against the state’s Republican establishment.

The law hadn’t taken effect yet. It was thrown out today amid high turnout in a year without a presidential election.

Republicans in the state who supported the measure will also have to carry the baggage of vouching for something that was overturned. And looking ahead to 2012, that's something that could potentially affect races at the federal level, as Democrats will surely blast Republicans who supported SB 5 and cast its repeal as a rejection of the GOP agenda.

20. Like we used to say needed to happen to bushco in 2004: they needed the snot beaten out of them.
Hand them a defeat that REALLY hurt.

That hurt their ego, their elitist sense of entitlement, their machinery, and MAYBE, even if just a wee bit, their bank accounts.

IN NO WAY close enough to steal.

Hands down.

Unspinnable.

Decisive.

Hopefully, an indicator for the future.

We didn't get this kind of result in 2004. We didn't repudiate bush/cheney. We had no signal to send or trend to start.

With this, we do indeed. And our Dems better make sure it's MADE into a trend-setter as far as public perception.

Here is some background on what Issue 2 is about: It is allowing voters decide whether to keep or repeal Senate Bill 5 - a historic rewrite of Ohio’s collective bargaining law, originally passed in 1983.

The choice voters faced today was this:

•A “yes” vote was to preserve Ohio's new collective bargaining law.


•A “no” ballot was a vote to repeal that law.

Here's what Senate Bill 5 does:


• Reduces the collective bargaining power of about 360,000 public workers in Ohio. The current collective-bargaining law gives workers the right to negotiate on a broad scope of topics including wages, hours, working conditions and any provision from an expiring contract that an employer wants to change. Under SB 5, workers no longer have the right to bargain changes from a previous contract. Certain topics that have been central to negotiations, such as health care benefits, can’t be bargained anymore. Several other topics can be bargained only if management agrees. These topics, known as “management rights,” include the right to decide employee qualifications, starting and quitting times, work assignments, promotion rules and other topics.
•Bans public-worker strikes.
•Eliminates binding arbitration, a process allowing a third party to impose a settlement when a union and management reach an impasse, and replaces it with a process that gives a governing body, such as a city council, the final say on a union contract.
•Eliminates “fair-share fees” - required payments to unions from workers who choose not to join their union. Fair share fees currently can be included in a collective-bargaining agreement as a term of employment.
•Places caps on paid personal days (three), paid holidays (12) and the amount of unused sick and vacation time a worker can cash in upon retirement.
•Eliminates automatic pay raises based on seniority and establishes a performance-based pay system.
•Prohibits seniority from being the sole factor considered when workers are laid off.
•Requires public workers to pay at least 15 percent of their health care costs and to contribute at least 10 percent of their salary toward their pension.

They thought they could coast to victory on anti-Obama rhetoric. Eventually the truth caught up with them. Even the healthcare bill the Republicans did pass is completely irrelevant.

They will now need to negotiate jobs vs benefits which is always ugly.... Ohio is looking at large cuts to public/state workers to balance the budget, taxes will not be raised under the current state government... The state keeps cutting funding to schools, & cities and even renewal levies are not consistently passing at the local level, nevermind new ones...

I'm just the messenger but it's going to get very ugly in the next 8 months in Ohio...

Issue 2 is simple. There is a right choice and a wrong. The health care bill is much more complex. There its a choice between "not great" and "terrible". That's a hard sell when you start at 36% against it purely on reflex, before anyone even starts to think about what choice to make.

In a political blow to GOP Gov. John Kasich, voters handily rejected the law, which would have limited the bargaining abilities of 350,000 unionized public workers.

Labor and business interests poured more than $30 million into the nationally watched campaign, and turnout was high for an off-year election.

The law hadn't taken effect yet. Tuesday's result means the state's current union rules will stand, at least until the GOP-controlled Legislature determines its next move. Republican House Speaker William Batchelder predicted last week that the more palatable elements of the collective bargaining bill — such as higher minimum contributions on worker health insurance and pensions — are likely to be revisited after the dust settles.

Watching the Ed Show tonight, the union members are talking union, but also talking rich vs. everyone else.

Meanwhile, Kasich faithfully promises that, since the people spoke so clearly, he, as a public servant, mut--wait for it--take a breath. :wtf:

And, Willard M. Romney had previously declared himself to be a strong supporter of the Ohio anti-union proposal, as well as the Mississippi anti abortion, anti-contraception, anti IVF bill, both of which lost tonight. No wonder the guy flip flops.

I live in a pretty socially conservative, red town in Boehner's district. At the city council debates they asked us about issue 2. All in attendance, even in this conservative area, hated the piece of legislation. I am very proud of my fellow buckeyes today!

Was just watching live Ed show on MSNBC in Ohio. There are some very happy middle class families and union people tonight.

As well as ballot measure in Mississippi to call "conception" a person--attempting to ban abortion. Take that you white-wing POS!!!

so says limbaugh. and he basically said kasich was a wimp, overreacting

i have heard a few GOP flaks acknowledge the defeat as significant but i suspect the right will not learn much, with the talk radio gods making the excuses.
