U.S. Asks Judge to Drop Mich. Ballot Case
LANSING, Mich. (AP) - The Justice Department asked a federal judge to dismiss a lawsuit filed by Michigan Democrats that seeks to require the state to count provisional ballots cast by voters who go to the wrong polling precinct.

The Justice Department argued in a friend-of-the-court brief Monday that the 2002 Help America Vote Act does not give individuals the right to sue if they believe their state has violated the law. Rather, they should go through a state administrative complaint process or rely on a U.S. attorney to file suit, the government said.

1. Woot, and there it is folks - the REAL "November" surprise
HAVA removed the right of the citizen to bring a lawsuit for voter disenfranchisement.

The DOJ fully intends to have every suit brought after the election dismissed for "lack of standing."

The voter is being completely shut out of the process. THAT was the intent of HAVA - not to repair the process of recounts (they eliminated them); not to make voter intent paramount in counting votes (they eliminated that); but to shut the citizen out of the legal process entirely.

At least he's not likely to be a wingnut. Does anyone know anything else about his background?
