12. I agree...I have paid hardly any attention to this
To me, the only larger relevance the case has pertains to whether the unborn baby will be deemed a murder too.

Stories like this get play because they get viewers, it is as simple as that.

TV networks are in the business of selling eyeballs, and tripe like this gets them. This is America. Lots of dumbasses actually find this crap interesting. Ti's like a cheesy soap opera, with the added benefit of being more or less true.

Too many of you just fail to recognize how lame the masses really are. One would think a recent vote would have clued you in :)

9. Well I care. I'm a true crime geek - this one has me stumped and I'm
curious about weather they jury rules on evidence or a presumption of evidence. Obviously, I'm not a lawyer. What little I do know, I feel like the State did not present their case, lack of evidence etc. I was totally dumbfounded by the DA's news camera jockeying.

However, if they could put someone in prison for being a pathological liar...then this would be an altogether different case.

10. With all the juror problems, they'll have trouble if they find him guilty
The defense will be polling the jurors for every irregularity. It is curious why those two jurors left.

The prosecution can't do anything about an acquitttal so it's over.

18. They get rid of two jurors, and all of a sudden they've reached a verdict!
I suspect that the root of the jury's problem had to do with the their understanding of circumstantial versus direct evidence. This reminds me of the Kenneth and Sante Kimes case--they were convicted because though the evidence was 98% circumstantial, there was just too much of it. I wouldn't award Peterson with an acquittal because he lucked out in terms of the forensic evidence washing away.

I'd say his chances of being executed are about ZERO - even if he gets convicted - which is doubtful.

16. I'm a crime hound and amateur sleuth
so this crime, while it is sadly too common, interests me greatly. Apart from the "whodunit" side, the issue of whether a viable fetus being killed means a second murder charge (in addition to the killing of the mother) is interesting. On one hand, I think Laci's Law may lead to a slippery slope that could be used to criminalize abortion. On the other hand, if I were happily 8 months pregnant and someone killed me, thus killing the fetus, I would be happy to see the killer pay for both murders. Since no mother in her right mind, except for severe health issues, would have an abortion at that late stage, I can see how someone could be charged for fetal homicide.

As to the verdict, while I believe Scott Peterson to be guilty due to a plethora of motives, I don't think the DA proved the case beyond the reasonable doubt. At the same time, the 2nd degree murder possibility that opened up recently may sway some jurors who would be thinking of convicting him, were it not for the 1st degree murder and death penalty.

It will be interesting to see what the verdict is.

if we recognize that a viable fetus is a living being, under the law, and can therefore be 'murdered' then he/she can also be manslaughtered. Failing to take due care, while pregnant, that results in the loss of life of the fetus (too much exercise, poor diet, slipping and falling while changing a lightbulb, any of these or a million other strage coincidences, could create a case in which the state could, quite reasonably, try the mother for neglect, negligent homicide or even manslaughter. Forget abortion, not wearing a seatbelt now beomce child endangerment. not taking your prenatal vitamins as prescribed by your doctor now becomes neglect. it's a slippery slope.

a married couple that isn't so happy.
wife is pregnant
wife engages in an activiity that leads to a late term miscarriage.
husband is enraged and seeks to have her convicted of murder because he feels their marital strife may have led her to put herself in dangerous situations.
jury convicts.
women are viewed once again as incubators for a man's seed.

25. Circumstantial Evidence
As I understand it -
ALL evidence is 'Circumstantial'. The evidence presented is The Circumstances surrounding the case. TV and The Movies have gotten us to accept the term "Only Circumstantial Evidence" as if it is not as good as some other kind. Like what? Eye witness evidence? It turns out eye witnesses are about as reliable as nothing, if you have one, OK, but if there are 50 there will be at least 50 different opinions as to what happened. What if they found a bloody glove on the scene, or had it on tape like Rodney King? Ahhh, that's just Circumst...well, you know
