Recess appointments and Bill Clinton

I've already seen several posts chiding people not to overreact about Bush's recess appointment of Pickering, because, as these posts point out, Clinton also made recess appointments (no comment on the interesting demographic of the folks making these comments).

My question: Did Bill Clinton ever make any recess appointments at the level of the Federal Appeals Courts? It's not my recollection that he did, but I thought I'd see if anyone knew for certain.

..was his appointment of Bill Lan Lee (sp?) to head EEOC at DOJ.

4. That was NOT a judge

It's perfectly normal for presidents (even unelected ones like Bush) to use recess appointments for lower level offices, but it is COMPLETELY unprecedented for Federal judges to get such appointments, especially after they have been successfully blocked by the Senate.

6. I'm well aware that he was not a judge..

..I was referring to recess appointments.

They all do it, for various reasons. Lan Lee was not well recieved in the Senate confirmation process. Clinton did the right thing bypassing them.

3. That black judge in Virginia (I forget his name)

I think it was for the 4th or the 6th Circuit (whichever one covers VA and the Carolinas). That court never had a black judge, and the Senate bottled up his appointment. Clinton made a recess appointment, and Bush later reappointed him permanently. I don't criticize him for using the recess appointment power. I criticize him for appointing a bad judge to the bench.

Clinton made a recess appointment of Gregory to the 4th Circuit.
