Don't expect Enron and the like to go to trial post-Martha
Settlement, settlement, settlement. It's gonna be ugly how easy these bastards are going to get off.

Lower your expectations now. :(

1. Settlements are for civil offenses. Criminals plead guilty and do less
time then they might had they gone to trial.

At least Martha has set the stage whereby juries will think if Martha got time, we can't let a crime 100,000 times worse get off with less.

She's created an important bench mark.

2. I'm holding out hope
I think Fastow has a lot of stuff on those guys or else he wouldn't have been able to cop a plea.
I get this gut feeling that the prosecutors on the Enron case are out for blood.
I've been a temp as a legal proofreader. In the past couple of years I've read first hand some of the case against Fastow and some of the bankruptcy cases. I think that the reason it's taking so long is not because these guys are going to walk, but the exact opposite.

I hope I'm right.

3. Maybe they'll settle, but the scope of the trespass was --
-- so great that it seems like somebody is going to have to serve time.

But you're right -- always a gamble with the justice system.

4. Kerry wins, Bush pardons, Lay walks...
Not a terrible tradeoff.

5. Lay et al will get off with the "Americans have had enough of the rich
Edited on Sat Mar-06-04 02:23 PM by stopbush
being sent to jail over victim-less crimes" mantra. "The example has been made...think of the CHILDREN!!"

Martha was the sacrificial lamb - small fry thrown to the wolves to set the stage for Lay and company to walk Scot free. In Martha's case, there were no victims. In Lay's case, there were thousands of victims who lost their livelihoods.

The repigs used the same line when bush took office, "Americans are tired of all the partisanship from the Clinton era. The last thing we need is another long and drawn-out witch-hunt. It's time to put that behind us and support our leaders." Yep. Witch-hunts are fine when Dems are the target. It's like having a neighbor who parties loudly until 4 AM, 7 days a week - and then calls the cops when you "disturb the peace" by mowing your lawn at 9AM the day after one of his all-nighters.

It's unbelievable.

7. I disagree. Martha sets the bar, and now convictions of others must clear
it.

She sets a good precendent, not a bad precedent.

8. Actually, I think Martha will win on appeal. But she'll still do jail time
while she appeals.

9. Which charge will she beat on appeal? This was a very easy case to make.
Everyone testified that they lied and that she tried to cover up evidence. She's not going to beat the fraud charges.
