FCC indecency questions

i'm writing a term paper for a media debates class on the topic and i've been assigned the postion of being against FCC regulation

in your opinion, what are some good arguments against it?

i'm going with the obvbious free speech one and the way it can be used as a political weapon.

does anyone have any ideas on other angles that might be good?

1. two other issues and a link
1) There is a Constitutional issue.

Supreme Court precedent says that laws have to be clear enough for the public to understand them. An unlclear law is invalid as "unconsititionally vague."

It's completely vague why one person talking about sex during a broadcast is illegal indecency but other people doing the same thing isn't illegal.


2) There is a corruption issue.

FCC officials accept free trips to Las Vegas from the companies they regulate.

They may be harsher on companies who didn't chip in for their free vacations.

3. Use the same court ruling the Repugs used in 2000
They stopped the recount because they said that due to different voting ballots used in the different counties, no uniformed code could be used to recount them.

The FCC code says that an item is indecent if it is offensive to an average person who might be listening. Since there are different "averages" all over America, there is no uniformed code. Also, due to the rise of internet radio, one could argue that an average listener is anyone, not just those who receive the air-bound signal.

Just my thoughts on it.
