seventh grader charged with felony for writing on desk . . .
I'm all for law and order, but this is getting ridiculous to the extreme . . . what's next? . . . jail time for failure to flush? . . . this country is insane . . .

A seventh grader from Sugar Land has been charged with a third degree felony for writing something on his desk. The boy's mother called on Action 13's Marvin Zindler for help.

James Tyler Frazier is a 12-year-old seventh grader. Back in February, he wrote bad words on his desk at Garcia Middle School in Ft. Bend County. The school's police made a report and turned it over to the district attorney's office. To everyone's surprise, that's when a third degree felony was filed against the youngster for gang graffiti.

How stupid can this be? I spoke to James' mother and her son. I asked her if they got James' handwriting off the desk.

"Yes, they wiped it off with cleaning fluid," she said.

a kid here in town, lit a trash can on fire in bathroom, felony adn intent to kill

stupid ass thing the kid did, and how many teenagers have done said stupid things. does that mean they are done living for rest of life with any chance to success. is this what we want to do as adults cause we feel out of control and dont know what to do.

4. I think it'd depend on what the kid wrote...
If it was something like "Bush Blows Goats", there shouldn't be any punishment. If, on the other hand, the kid wrote "I'm going to get a gun and kill Suzy, cuz the Crips Rule!!!" and drew a picture of Suzy dead with a gunshot wound to the head, well, in that case, I'd think it should be taken a tad bit more seriously.

And yeah, the reporter looks like some kind of combination fundie snake-handling pastor/child molester/cannibal freak. If I saw him coming towards me on the street, I'd switch sides.

Marvins been the Houston "consumer advocate" reporter for 100 years now. Every Friday night, he has his "rat and roach report" spotlighting some of Houston's first class dining establishments. That thing on his head is a wig, as he is completely bald and has had about 50 plastic surgeries on his face. He cheerfully explains that he must do this in order to remain on TV. His biggest claim to fame is being the reporter who busted up "the best little whorehouse in Texas." In Houston, he's given a wide berth and there is no way in hell any prosecutor will fuck with him because of his popularity.

24. But it didn't sound like he was charged with making death threats just
grafiti. I fail to see how doodling on one's desk equals grafiti but even if it does how can it possibly be a felony. Especially since it was so easily cleaned up.

7. felony = at least a year in prison.
for writing 2 bad words on his desk, with an ink that's easily removed with cleaning fluid. for a 12 year old.

doesn't matter the words, doesn't matter the ink. this is a *child*. does at least a year of prison time seem like fair and usual punishment? unbelievable. if convicted the ACLU better get their ass in gear and protect this kid against cruel and unusual punishment. just completely unbelievable.

8. when I was a kid
we use to carve stuff in our desks and years later it would still be there. Siblings would look for their older brothers and sisters work. It was a pain, though, to have a whole in your desk and punch your pencil through the paper every time you wrote. You would get detention and your parents would give it to you when they found out, but no one went over the top about it and called the police.

- them weenie firecrackers in a string of 25 or so?

well, one of us, I don't remember, it could have even been me, threw a string on the hood of a passing car . .

oops !!

turned out to be a local COP car!


We were promptly marched to our respective homes, where our respective parents beat our little bums raw . . .

Nope, no proof

No police report

No police record

No charges , ,

AND

we never did it again!

11. I don't think I was ever in a middle or high school classroom where
at least one desk didn't have a swastika carved in it. And this was uber-progressive Seattle.

Kids are stupid, insensitive shits. I can't imagine a single thing he could have written that would merit worse than expulsion and possibly probation.

they did include the "gang" code word. This looks like a case of misbehaving at school while black - a felony in Texas.

I'd like to know this child's race and socio-economic status.

I'll wager that he is either a non-Caucasian and/or his family is from the lower rung of the S-E ladder.

23. I haven't lived in Houston for 10 years now, but
Sugarland is one of those rich, mostly white, suburbs. The VP from Enron who offed himself lived there.
