Anyone remember the US exception to the World Court?
Don't remember the details, but in the early days of the War on Terra, Bush made a deal that the US could not be brought up in front of the World Court for war crimes in the wake of Sept 11.

Convenient.

Anyone else remember this?

Will it impact legal action aimed at the torture of the Iraqi POWs from outside the US military? Are they untouchable?

1. Yep
The Military over there can be court martialed. But the Mercs directing the interogation are untouchable by my understanding of the matter.

2. Oh "I" remember
but you know, looks to me like we will have to turn these folks over to the world court, no matter that they say this does not apply to me.

3. Sloboban Milosovich thought he was untouchable
but was turned over to the court.

The Senate never ratified the ICC treat but that doesn't mean the world can't eventually bring renegades to trial.

4. The US did not "sign on" to the International Criminal Court...
and has been threatening, bribing, etc, countries into signing agreements that they will not "turn" over those who have been indicted by the ICC. It is disgusting, imo, especially in light of Iraq. It seems, and I stand to be corrected, that bush could be indicted as a "war criminal" by the ICC and if he were to go to a country that is a signatory to the ICC and did not bend to the US will, that country could ship bush to the Hague.

8. Except for Bilateral Immunity Agreements
"Second, the Bush administration is requesting states around the world to approve bilateral agreements requiring them not to surrender American nationals to the ICC. The goal of these agreements ("impunity agreements" or so-called "Article 98 agreements") is to exempt U.S. nationals from ICC jurisdiction. They also lead to a two-tiered rule of law for the most serious international crimes: one that applies to U.S. nationals; another that applies to the rest of the world's citizens. Human Rights Watch urges states not to sign impunity agreements with the United States."

6. They covered their butts early in the game
In MAY 2002 the Bush* Administration opted out of participating in the International Criminal Court that prosecuted war crimes.

They knew what was coming even if the American public didn't!

Meaning, of course, kiss my ass 'cause I love you! No, you don't scare me, I really, really love you!

9. IIRC, the ICC has no jurisdiction over countries that are not signatories
to the Rome Statue.

But also IIRC, for the past 2-3 years, dubya has gone before the UNSC and demanded the US be exempted from the ICC.
