WASHINGTON (CNN) -- U.S. Supreme Court Justice David Souter was assaulted by several men Friday night and taken to a hospital with minor injuries, according to a court spokeswoman.

The incident occurred while he was jogging at about 9 p.m. Friday, said Kathy Arberg, a court spokeswoman.

Another source told CNN the incident happened near his home.

Arberg said Supreme Court police escorted the justice to Washington Hospital Center. He was examined and released at about 1:30 a.m. Saturday morning.

I am copying some of the LBN post (by DUer Pallas180):
jogging this morning. News flash on CNN. Beaten and taken to the hospital.

Certain talk shows have been bashing Sauder as "the liberal" and
one of Bush's nominees on C Span during his confirmation hearing said "we don;t want anymore judges like Justice Sauder".

Something tells me that the "you=know-who" crazies who view him as the obstacle, have attempted to "remove" Judge Sauder so that they can get their abortion laws through. I would rather think that then the more sinister thought that someone in government arranged it.

Sauder is very instrumental in the balance of the court.

A woman's right to choose and gays rights and a half dozen other issues hang in the balance.

I hope for his sake, the sake of his family and the sake of Democracy in the United States this man is ok.

The attack occurred about 9 p.m. Friday, as Souter, a regular jogger, ran alone, court spokeswoman Kathy Arberg said.


Supreme Court police took Souter, 64, to a Washington hospital, where he was examined and released about 1 a.m. Saturday, Arberg said. She did not detail his injuries except to say they were minor.


Souter was not robbed, Arberg said.

but unless there's overwhelming evidence that this was a completely random attempted mugging, bitter experience of life since 2000 teaches me to assume the worst.

We went through the looking glass on December 12, 2000 and none of the aspects of American public life we could once count on are safe anymore.

As far as I can tell, he's a fairly centrist consensus-builder and a honorable jurist. However, for the RW nutjobs he's on the "wrong" side of a lot of hot-button social issues. He was nominated by King George I and the wingnuts have been bitterly disappointed that he's not as certifiably insane as Scalia and Thomas.

I'm honestly surprised they don't have Secret Service protection - they are high-profile government officials, and probably the most likely to be attacked, since they can't be elected out of office.

So just give all nine of them protection, and prevent it from being cast as a "partisan" issue.

Several young men, assault him giving him minor injuries but they didn't rob him and it happened near his home.

I would be interested in knowing what kind of area this Justice lives in. Is it a gated community? What is the crime rate for his neighborhood? Does he jog the same route every time? The same time? Is the area well lit? How many men attacked him? Any witnesses?

It says he wasn't robbed, but most people don't jog with their wallet or anything of value except maybe a walkman and a watch. Are there any statistics on muggings/assaults on joggers? Is it normal to rough them up without attempting to rob them of anything?

Does anyone have any more questions?

actually know what supreme court justices look like, I figure they saw a n old white man jogging through a park at night and wanted to hit him up for cash, unfortunately for them he wasn't packing anything but his ID and keys (that's what I do when I go jogging). It seems that Souter was just an unlucky victim of circumstance. I'm new here but I've found that many people like to break out the tinfoil.....I think you should start keeping the Reynolds wrap next to your monitor

45. Well, logically, if the
intent from the start to was to rough up or incapacitate Souter specifically, then the men would've definitely known what he looked like, and would've known of his routine of jogging.

Even thugs on the street, when looking for someone to mug, will look for someone who might have a wallet or purse. Not a guy jogging, who even thugs know isn't likely to have his wallet on him.

Something doesn't pass the smell test here and I don't often don the tinfoil hat.

There's a fairly new book, "Dark Horse" that shows his assassination to be a product of intra-party (Repub.) squabbles that led to a hanger-on to believe that by shooting the president he would become a hero. Garfield was in office a few months when he was shot, but lingered on for another 2+ months, finally dying of infection caused by the doctors' dirty fingers probing his wounds.

This situation was a lot like today's. Sort of like a moderate being killed by a rabid right-winger, someone influenced by the poisonous atmosphere within the party.

Then there's President McKinley, killed by an "anarchist."

George Lincoln Rockwell, head of the American Nazi Party, if you want to consider him Republican, was shot, too, in 1967.

58. Incapacitating any ONE of the current Justices
would mean that Bush* could put a very young, very reich-wing Justice on the Supreme Court before he leaves office. Their appointment is a life-time appointment.

The reich-wingers are getting desperate that they haven't been able to get a brownshirt on the US Supreme Court.

I think they were counting on one of them stepping down, but clearly the moderates and those left of center have decided to wait until perhaps Bush* is out of office to step down.

They were just trying to move the process along a little bit by taking out an easy mark---like a Justice who jogs in a routine manner like Souter.

68. Geez. One more "incident" to add to the list.
Someone in the Government arranged that to happen. It's meant to send a warning about how to vote on the Cheney Energy hearing. The GOP are evil bastards. This is NOT another "coincidence." There's a hearing on Cheney's Energy Meetings and coincidentally THIS happens? No way. The GOP did this.
